State’s Attorney’s Office Secures No Bond in First Degree Murder and Attempt Murder Case

Garibay

Juan C. Garibay

(Lake County, IL) - A Beach Park man will be held in jail without bond after prosecutors successfully argued that he posed an ongoing danger to the community in light of the murder charges he faces.

Juan Carlos Garibay, 42, is charged with shooting to death one man and seriously injuring another after an attack in the 1400 block of Lorraine Place in Waukegan.

During a Saturday morning hearing, Lake County Circuit Judge Michael Betar granted Assistant State’s Attorney Jason Humke’s oral motion to hold Garibay without bond. Humke stated in court, “Both victims were at the garage of the residence working on a vehicle when Garibay approached and opened fire on them.”

ASA Humke elaborated that Waukegan police obtained the defendant’s cell phone and were able to put him within the vicinity of the crime. He also indicated that Garibay is still on parole from a previous conviction.

Garibay was convicted in 2003 for second degree murder and sentenced to 15 years to be served at 50%.

According to witnesses, Garibay arrived at the location masked and carrying a firearm. After shooting one man in the back and one man in the head, Garibay fled in a car.

Humke indicated that, given Garibay’s past history and the witnesses in the case, “the state believes he is a clear and present danger to the community,” and should be held without bond. Under the current law, a court can hold someone without bond if the charges fall within a narrow class of offenses. First degree murder with a firearm and attempt first degree murder with a firearm qualify under the law.

The investigation is ongoing and the Waukegan Police and Lake County State’s Attorney’s Office have been cooperating since Thursday evening.

State’s Attorney Eric Rinehart expressed sympathy for the families of the victims. “We are praying for the families of both victims and for the full recovery of the injured victim. The State’s Attorney’s Office will dedicate as many ASAs as needed to secure a just outcome in this case.”

An attorney from the public defender’s office represented Garibay, and Judge Betar set the matter over for a preliminary hearing on September 14 at 1pm.
