Chicago Man is Charged with Armed Habitual Criminal
EVANSTON, IL - On January 6, 2024, at approximately 11:35 p.m., Evanston officers were on patrol in the 2000 block of Darrow when they observed a blue Chrysler 300 double-parked. The officers also observed that the vehicle did not have a front license plate and had dark tinted windows. The officers stopped and approached the vehicle to investigate further.
The officers made contact with the vehicle’s passenger and sole occupant, Alston Rodriguez. While speaking with Rodriguez, officers observed an open bottle of Don Julio tequila at his feet. Rodriguez initially refused to identify himself to officers or roll down the window further at the officer's request. Based on Rodriguez’s behavior and limited visibility due to the tinted windows, officers had Rodriguez exit the vehicle.
While exiting the vehicle, Rodriguez began to move his hands toward the front of his waistband. Once Rodriguez was out of the car, an officer attempted to position him for a patdown search, and Rodriguez swatted the officer's hand away from the front of his waistband. The officer was then able to take control of Rodriguez, check his waistband, and recover a loaded black Ruger 9 mm handgun. Rodriguez was taken into custody without incident and transported to the station. The driver of the Chrysler returned, was issued a parking ticket, and the vehicle was released to him.
Rodriguez did not have a FOID card or a Concealed Carry License. The Cook County State's Attorney's Office reviewed the investigation and, based on Rodriguez’s criminal history, approved a felony count of armed habitual criminal. Rodriguez was also cited for open alcohol by a passenger.
