Traffic Stop Leads to an Unlawful Use of a Weapon Charge
 EVANSTON, IL - On December 13, 2023, at approximately 11:40 p.m., Evanston Patrol Officers were on patrol in the area of the 2100 block of Howard Street when they observed a black Honda SUV with a suspended registration. The officers performed a traffic stop on the Honda.
Upon stopping the vehicle, an officer made contact with the driver, Eugenio Hernandez-Martinez, and the passenger, who was the registered owner. Officers could smell an odor of cannabis coming from inside the vehicle. When they inquired about the odor of cannabis, Hernandez-Martinez stated he had smoked cannabis before driving, but there was no cannabis in the vehicle. The officers had Hernandez-Martinez and the passenger exit the vehicle in an effort to continue their investigation.
Once the occupants had exited, the officers searched the vehicle. Their search led to the recovery of a loaded Taurus 38 revolver handgun. Hernandez-Martinez volunteered that the gun was his. Hernandez-Martinez was arrested and transported to the station for further investigation.
Once the officers arrived at the station, they continued their investigation. The investigation revealed that Hernandez-Martinez did not have a FOID card or a Concealed Carry License. He also made the statement that the handgun was his and that he had purchased it three years ago for protection. The Cook County State's Attorney's Office reviewed the investigation and approved one felony count of aggravated unlawful use of a weapon. Hernandez-Martinez was also cited for suspended registration. The passenger was released at the scene.
