Des Plaines Police were on patrol in the area of Lee Street near Forest Avenue when a gray Kia K5 with Kentucky registration was seen on Lee Street traveling southbound at a high rate of speed. The officer had his front mounted radar unit active and captured the approaching vehicle's speed at 61 MPH in a marked 30 MPH speed zone. The officer conducted a legal U-turn and pulled behind the Kia as it abruptly turned west into the rear of a parking lot in the 1100 Block of E. Oakton Street.
The officer followed and activated his overhead emergency lights stopping the vehicle and made an approach to the driver's side of the Kia. Once there, the officer spoke with the subject, Sean Hernandez, and informed him the reason for the traffic stop while also requesting his driver's license and proof of insurance. While the officer was speaking with Hernandez, he observed an open container of alcohol in the cup holder and an electronic smoking device, suspected of containing cannabis, in the second cup holder located in the center console.
Hernandez was asked to exit the vehicle, to which he complied, and upon exit, the officer attempted to conduct a pat-down of his person. During this, Hernandez continued to move his body away from the officer that indicated he was attempting to conceal something on his person. The officer located a hard L-shaped object protruding from Hernandez' front pant pocket consistent with a firearm. Hernandez was taken into custody, and a Glock 42 handgun was removed from his person.
Upon running Hernandez' information, the officer learned that he did not possess a valid Firearm Owner's Identification Card. After Hernandez was secured, the officer then searched the vehicle which led to finding a white pill on the inside driver's door which was suspected of being hydrocodone, known to be a controlled substance. All items were recovered and along with Hernandez, transported to the Des Plaines Police station. Once there, officers confirmed the pill was hydrocodone and learned that Hernandez did not possess a prescription for the drug.
Due to the nature of the incident, the Cook County State's Attorney's Office was contacted and who then approved felony charges. Hernandez was subsequently arrested for one felony count each of Aggravated Unlawful Possession of a Weapon and Possession of a Controlled Substance; one misdemeanor count each of Firearm Owner's Identification Required, Possession of Adult-Use Cannabis in a Motor Vehicle, Possession of Drug Paraphernalia, Speeding 26-34 MPH Over the Posted Speed Limit; ticketed for the Operation of an Uninsured Motor Vehicle and Illegal Transportation of Alcohol by a Driver. He was cited and released with his court information.
