JUNE ADMINISTRATIVE RULES REGULATIONS & FEES BULLETIN BRIEF SUMMARY

Last month while many engaged citizens were concentrating on the primary election, the Idaho Health and Welfare Department passed a temporary rule (through the administrative rules and regulation process) to allow transgender people to change the sex on their original birth certificates.  This is the same administrative process is that brought  Common Core to Idaho and continues to insert federal code into our state code, making our Idaho bureaucrats nothing more than an enforcement arm to the federal government. 

 

The good news is the Idaho administrative rule process allows and encourages citizens to provide input and encourages agencies to take public comment into consideration before presenting the final language to the Legislature for adoption of the final rule.   Idaho is one of only two states that allows this!  Remember, once these rules are adopted (in bulk) they have the full force of law.

 

When we do not exercise our power as citizens, we lose it.  PLEASE consider commenting on any of the rules below that may effect you, your family, or the friends and businesses you know.   


 

 Five simple steps to help control your government through the rules process:

  1. Click on this link to view to the entire June Bulletin of administrative rules and regulations:  https://adminrules.idaho.gov/bulletin/2018/06.pdf
  2.  Look through the table of contents to see if any of the rules will effect you.  (don't be intimidated by the length of the bulletin.  Only focus on what effects you personally.)
  3. Go to the section that will effect you and read the short summary and how to comment on the language. (usually only 1-3 pages)
  4. There will be directions on how to comment.  Send in a comment, participate through teleconferencing, or get 25 signatures to call for a hearing, in your area.
  5. Remember, ALL power is in the people and the government is set up to serve you.  If we do not get involved in this process as citizens, government will do as they will unchecked.  

BELOW IS A BRIEF SUMMARY OF THIS MONTHS RULES.  IF YOU DO NOT SEE ANYTHING YOU ARE CONCERNED WITH, THERE WILL ALWAYS BE NEXT MONTH.  RULES ARE RELEASED THE FIRST WEDNESDAY OF EACH MONTH BY THE AGENCIES.

DEPARTMENT OF FISH AND GAME: Rules Governing the Taking of Big Game Animals (air guns meeting certain requirements, disabled, senior, and non- resident disabled American veterans secondary application period), the Importation, Possession, Release, Sale, or Salvage of Wildlife, Trapping of Predatory and Unprotected Wildlife and the Taking of Furbearing Animals (distances for setting traps next to public trails), Rules Governing the Use of Bait and Trapping for Taking Big Game Animals (synthetic only).


IDAHO DEPARTMENT OF LANDS: Dredge and Placer Mining Operations in Idaho, Rules Governing Exploration, Surface Mining, and Closure of Cyanidation Facilities, Rules for the Regulation of Beds, Waters, and Airspace Over Navigable Lakes in the State of Idaho. The Idaho Department of Lands (Department) is also developing a web-based portal and information management system that will allow for submittal of applications and other documents electronically.

IDAHO INDUSTRIAL COMMISSION: Administrative Rules of the Industrial Commission Under the Workers' Compensation Law – Benefits, Procedures to Obtain Compensation, Miscellaneous Provisions, Medical Fees and Security for Compensation for Insurance Carriers and Self-Insured Employers. (requirements for and filing documents to reflect Electronic Data Interchange Filing-Electronic Data Interchange.

BUREAU OF OCCUPATIONAL LICENSES: Rules of the Real Estate Appraiser Board.

STATE TAX COMMISSION:  Idaho Sales and Use Tax Administrative Rules, Property Tax Administrative Rules, Idaho Motor Fuels Tax Administrative Rules, Hotel/Motel Room and Campground Sales Tax Administrative Rules, Idaho County Option Kitchen and Table Wine Tax Administrative Rules, Idaho Cigarette and Tobacco Products Tax Administrative Rules.

DEPARTMENT OF HEALTH AND WELFARE:  Medicaid Basic Plan Benefits, Medicaid Enhanced Plan Benefits, Rules and Minimum Standards for Hospitals in Idaho.  (Update and revise rules for swing bed limitations, necessary days to address patient need and special rates for ventilators and tracheostomy.)

IDAHO STATE BOARD OF DENTISTRY: Rules of the Idaho State Board of Dentistry relating to dentistry in long-term care facilities and elimination of the option of supplemental dosing when providing minimal sedation to patients.

 BOARD OF PHARMACY: Rules Governing Pharmacist Prescriptive Authority clarifying that pharmacists can prescribe statins to patients “who have been diagnosed with diabetes” within certain parameters.
