Agency Legislation
Per Idaho code, the Idaho Oil and Gas Conservation Commission (OGCC) is attached to IDL for administrative purposes.
In August 2021, the OGCC directed staff to study Idaho Code § 47-3, Oil and Gas Wells – Geologic Information and Prevention of Waste, and make recommendations for improving the law based on lessons learned since 2017 when the statutes were modernized by the Idaho Legislature.
This direction resulted in a year-long process rooted in public involvement that culminated in the Commission approving the sixth draft of proposed statutory changes. To ensure citizens’ voices were heard during this process, staff launched a public outreach webpage that documented the process and solicited feedback from all stakeholders.
The resulting legislative proposal, approved by the Commission at its May 19, 2022, meeting:

Provides additional guidance to operators, mineral interest owners and the state.

Improves and clarifies reporting guidelines for operators.

Changes the makeup of the commission by removing the Director of the Department of Lands.

Updates the technical requirements of commissioners to better reflect the needs in Idaho.

Defines just and reasonable terms for integration.
House Bill 120 - Oil & Gas (UPDATED)
In 2017, the Idaho Legislature modernized Chapter 3, Title 47, Idaho Code to provide additional guidance to operators, mineral interest owners, and the state. There were significant changes to statute at that time. After five years of operating under these new guidelines, the OGCC is recommending some additional changes to provide clarity to stakeholders. These changes improve and clarify reporting guidelines for the operator, allow changes to the makeup of the commission by removing the Director of the Department of Lands as well as changing the technical requirements of commissioners to better reflect the needs in Idaho. The changes also clarify just and reasonable terms for integration. Building these terms into statute allow mineral interest owners to be made aware of these terms prior to integration as required by the U.S. district court decision CAIA vs. Schultz.

This legislation relates to real property valuation for tax purposes and requires the numerical breakdown of the exempted value to be provided to parcel owners. It defines special purpose commercial property and methods that may be used to establish the real property market value for assessment purposes.

House Bill 102 - Pay Advancements, Retention Bonuses (NEW)
This legislation adds language to 67-5309B and 59-1603 to clarify that salary increases based on performance require a current evaluation to be on file and that other salary increases may be given based on internal pay equity or external market changes. This change will allow agency heads to recruit and retain state employees more effectively.

This legislation maintains all protections for Idaho taxpayers in the public bidding process and makes adjustments for inflation in the personal property procurement process.
Rulemaking
In general, the Idaho Legislature first sets policy mandates by passing statutes, then state agencies create administrative rules to aid in implementing the statutes, if needed. This process allows for the public along with scientific, economic, or industry experts to help guide how statutes are implemented by state agencies.
Rules for Selling Forest Products on State-Owned Endowment Lands
IDAPA 20.02.14 - Pending Rule
The Rules for Selling Forest Products on State-Owned Endowment Lands (IDAPA 20.02.14) apply to purchasers of state endowment timber sales and forest products.
This administrative rule establishes a consistent process for selling forest products from state endowment lands by setting minimum requirements for timber sale auctions, initial deposits and bonding, stumpage and interest payment, and timber sale cancellation and termination.

Rules Governing Leases on State-Owned Navigable Waterways
IDAPA 20.03.17 - Pending Fee Rule
The Rules Governing Leases on State-Owned Submerged Lands and Formerly Submerged Lands (IDAPA 20.03.17) establish a consistent process to authorize specific encroachments on state-owned submerged lands and collect annual rent for their use. These uses typically include marinas, community docks, non-navigational encroachments, and oversized private docks that occupy the state’s lakes.
This lease program is funded by the Navigable Waterways Fund, a state dedicated fund. As a dedicated fund, those who benefit from this program pay for the services it provides. This rulemaking increases application and assignment fees to cover the actual administrative costs of processing submerged land leases.
Current lease holders will not be affected by this fee increase now, but applicants for new leases and those seeking to renew expiring leases in the future will pay increased fees. No fiscal impact to the General Fund is anticipated.

Reports Due to the Legislature
Annual Report
Annually on or before December 1, IDL is required to report to the Land Board concerning the condition, management and financial transactions of the department.
GNA
IDL shall report to the legislature and federal agencies, as appropriate (at least annually) as to the status and performance of any proposed or executive agreements under GNA.
Hazard Pay
IDL shall submit a report to the Division of Financial Management and Legislative Services Office detailing Hazard Pay provided during the previous fiscal year.
Land Exchange
On or before January 15 of each year the Land Board shall submit a report to both houses of the legislature and to the Audit Division of the Legislative Service Office about state endowment lands exchanged and acquired.
Off-Highway Vehicle (OHV) Fund
IDL shall annually publish a report specifically identifying the uses of money allocated pursuant to the subsection.
Over Snow Vehicle (OSV) Fund
IDL shall annually publish a report specifically identifying the uses of money allocated pursuant to the subsection.
Qualifying Contracts
State agencies must report annually to the legislature on all qualifying contracts entered into by the agency the previous year. It must include the following for each contract: the amount, the duration, the parties, and the subject.
Timber License Plates
IDL shall prepare an annual report that is sent to ITD regarding revenues and expenditures associated with funds collected for the special license plate.
