Chapter 69 Legislative Session Delay

During their meeting on September 8, 2025, Iowa Administrative Rules Review Committee (ARRC) voted to enact a ‘session delay’ on the new Chapter 69 rules. This means that the new Chapter 69 rules that were approved by the DNR Environmental Protection Commission (EPC) on July 15, 2025, are delayed (not effective) until the end of the next Iowa legislative session in 2026. The new Chapter 69 rules will become effective on the final day of the 2026 legislative session unless the Iowa Legislature takes action that impacts the new rules during the session.

In the interim, the existing Chapter 69 rules that went into effect in 2012 will remain in effect. We understand that there have been many changes to our wastewater and septic tank cleaner rules (Chapters 60 and 68). The new rules for Chapters 60 and 68 were not delayed and are currently in effect. Where there is a conflict between the current versions of Chapters 60 or 68 and Chapter 69, the newest version of the rule is in effect. For example, the separation distances have been moved to Chapter 60 and still exist in the ‘old’ version of Chapter 69. In this case, the separation distances in Chapter 60 should be used.
