IOWA DEPARTMENT OF AGRICULTURE APPOINTED RECEIVER OF HEARTLAND CRUSH, LLC IN MARENGO

DES MOINES – The Iowa Department of Agriculture and Land Stewardship has been appointed to act as receiver of Heartland Crush, LLC in Marengo and take custody of the grain dealer assets pursuant to Iowa Code section 203.12B. Heartland Crush was an unlicensed grain dealer and therefore any farmer losses will not be covered by the Iowa Grain Indemnity Fund.

Anyone who sold grain to the company and was not paid may file claims with the Department until Feb. 7, 2019 against any commodities or proceeds that are still held by the company. Failure to timely file a claim shall defeat the claim unless excess proceeds remain after all timely claims are paid in full.

Claims must be sent by certified mail, return receipt requested, to Iowa Department of Agriculture and Land Stewardship, Grain Warehouse Bureau, 502 E. 9th St., Des Moines, IA 50319. Claims must include a copy of the scale ticket, settlement sheet, other evidence of sale or documentation of a secured interest in the company’s property.

The Iowa Department of Agriculture and Land Stewardship’s Grain Warehouse Bureau regulates and examines the financial solvency of grain dealers and grain warehouse operators. The functions of the Bureau include: warehouse licensing, warehouse examination, grain dealer licensing and grain dealer examinations.
