NOTICE TO INDUSTRY:
Updated Resources for Commercial and Personal Policy Forms
To Property and Casualty Insurers Authorized to do Business in Florida
The Florida Office of Insurance Regulation (OIR) is providing this notice to all property and casualty insurers authorized to do business in Florida announcing the availability of updated resources for personal and commercial policy forms.
These instructions and checklists include statutes and rules which apply to the respective policy forms, but may not contain all of the requirements for a filing. OIR recommends that insurers refer to the checklists and the cited statutes and rules for instructions and guidance.
A Line of Business Matrix is also now available to assist insurers with submitting form filings under the correct line of business.

Commercial Form Filings: Commercial Property, Commercial Auto, and Other Commercial
Commercial forms are exempt from prior approval pursuant to section 627.4102, F.S. However, insurers can get their products to market quickly by certifying their forms in an informational filing. OIR created commercial form filing checklists as a resource for companies to help facilitate these efforts.
To Certify and Submit a Commercial Informational Form Filing:
- Use a commercial form filing checklist to ensure the elements of the form are accounted for. The following checklists are available for commercial policy forms:
- Submit the form electronically to OIR as an informational filing through the Insurance Regulation Filing System (IRFS), 30 days before the delivery or issuance for delivery of the form within this state.
- Attach a notarized certification to the filing at the time the informational filing is made, which certifies that each form within the filing is in compliance with all applicable state laws and rules. Section 627.4102, F.S., requires that the certification must be on the insurer’s letterhead and signed and dated by the insurer’s president, chief executive officer, general counsel, or an employee of the insurer responsible for the filing on behalf of the insurer and must contain the following language:

"I, (name) , as (title) of (insurer name) , do hereby certify that this form filing has been thoroughly and diligently reviewed by me and by all appropriate company personnel, as well as company consultants, if applicable, and certify that each form contained within the filing is in compliance with all applicable Florida laws and rules. Should a form be found not to be in compliance with Florida laws and rules, I acknowledge that the Office of Insurance Regulation shall disapprove the form.”
Converting Commercial Forms Previously Submitted for Approval:
Insurers with commercial form filings previously submitted for approval, which are eligible to be made as informational filings, can convert those filings to a certified informational filing utilizing the checklists as a guide to compliance before uploading the notarized certification in IRFS. If insurers have already received communication from OIR related to the filing, the best practice is to allow OIR to complete the approval process for the filing.

Personal Form Filings: Personal Residential and Private Passenger Auto
OIR updated personal residential and private passenger auto form filing checklists as a resource for companies to help provide guidance when submitting personal policy forms.
Personal policy forms must be submitted for approval to OIR through IRFS. Insurers are encouraged to use the personal policy form filings checklists and attach a copy of a completed checklist with the filing.
