Energy Performance Contract Project Update
- The project team presented the Energy Performance Contract and proposed improvements in anticipation of the 2026 budget discussion. The Colorado Energy Performance Contracting Program is a funding and contracting tool that allows public entities to use future savings from energy improvements to fund capital projects. Highlights of the proposal include leveraging over $4 million in available funding from state and federal government; $1.2 million in avoided capital costs; enhanced safety and security in parking garages; 14-year simple payback; new heating and cooling at library; resiliency at Donovan Pavilion; and installation of the first geothermal node for the energy district project. The team will return with additional details as the budget process continues.

Nature Center Discussion
- Town Council heard input gathered at the Sept. 5 Ford Park Advisory Committee meeting regarding the Vail Nature Center, including both the physical structure and programming. Council members agree with an approach that would focus on creating a quiet, natural space before incorporating any new or continued programming. The onsite yurt has been listed for sale and will come down this fall. An amount of $50,000 or less is anticipated to be included in the 2026 budget for maintenance of the site and farmhouse.

Capital Projects Budget Discussion
- Staff presented high level revenue projections as well as more in-depth information on the town’s proposed 5-year capital expenditure plan, including significant capital projects proposed as a part of the 2026 budget. Within the total proposed capital expenditures, $11.9 million is related to maintenance and routine replacement of the town’s existing assets, while $37 million is related to the acquisition of new assets or enhancing existing assets. The majority of this amount, or $22.4 million, is related to the acquisition of employee housing units at Timber Ridge. Feedback provided by the Town Council included will be incorporated in the 2026 Town Manger Budget Draft scheduled for the Oct. 21 meeting.

Compensation and Benefits Discussion
- Continuing with 2026 budget discussions, Town Council heard a preliminary overview of the proposed employee compensation and benefits plan. Compensation recommendations include range adjustments to reflect market movement; a merit pool recommendation of up to 5% based on performance; minimal market adjustments; and continuing a special recognition pool to recognize exceptional performance. Benefits changes are proposed at a below-average trend increase of 1 to 2% for 2026 medical insurance; flat to minimal increases for dental, life, and other insurances; and a slight increase to the lifestyle spending account/ski pass benefit. Council was supportive.

Car Share Program Update
- Staff provided the Town Council with an overview of responses to a Request for Proposals for a Vail Car Share Program. Feedback included simplifying the rate structure and ensuring subscription fees are not barriers to entry, Council members also asked about branding opportunities to help encourage adoption. Town Council was supportive of moving forward with Zip Car. Staff will return with additional details.

Discussion of Proposed Amendment to EHU Exchange Program
- Staff is proposing an amendment to the Employee Housing Unit Deed Restriction Exchange Program, which allows the Town Council to release an existing EHU deed restriction in exchange for placement of a new deed restriction on another dwelling unit or a fee in lieu payment to the town. These exchanges are focused on helping turn over underperforming deed restrictions. The proposed amendment is intended to provide additional flexibility for fee in lieu exchanges that will further incentivize the transition of underutilized deed restrictions into new housing. Three key points in the proposed amendment are that it would be applicable to all underutilized EHUs, it affirms the fee-in-lieu calculation method, and it allows room for fee negotiation and reduction within a range. Council was supportive of an option that ties the fee in lieu calculation to a market analysis, which would help ensure the town receives fair market value for deed restrictions. In the evening, Council approved Ord. No. 20 on first reading.

Contract Negotiation for Rockfall Mitigation
- The town is working to complete rockfall mitigation above the Timber Ridge Village development. Initial efforts of rock scaling earlier this summer were unsuccessful and the town now needs to shift methods to provide mitigation. Staff is requesting to move forward with a contract for design work. An update on the contract award and proposed mitigation will be provided at the next meeting. Council was supportive.

Discussion of Resolution No. 45, Series of 2025, A Resolution of the Vail Town Council Adopting the Town of Vail Procurement Policy
- Staff is recommending updates to purchasing thresholds that define when a formal contract is required, as well as the approval levels tied to different dollar limits, which have not been revised since 2008. Staff is also recommending rescinding the related section of the Vail Town Code through second reading of Ord. No. 18, included later on the evening agenda. Council was supportive.

Discussion of Ord. No. 19, Adopting by Reference the Model Traffic Code for Colorado, 2024 Edition
- The Vail Police Department is proposing to update the Town of Vail’s Model Traffic Code (MTC) from the 2020 edition to the newly released 2024 edition. Adopting the 2024 MTC will align the town’s traffic regulations with statewide updates, improve clarity in enforcement, and provide a framework for addressing emerging transportation technologies. Council was supportive.

Public Comment
- Douglas Smith and Davy Gorsuch announced their upcoming event this weekend to help support mental health in Eagle County. “Good Music For a Good Mynd” is taking place on Oct. 11 and 12 at the base of Gondola One in Vail Village.
- Steve Lindstrom of the Vail Local Housing Authority announced Eagle County’s additional contribution to Habitat for Humanity homes at Timber Ridge. He thanked the commissioners, the Town Council, and staff from all three organizations.
- Mae Yang and Michael Boland thanked the Town Council for the opportunity to propose a concept for the Vail Transportation Center café space.
