West Middle Creek Update
- Members of the West Middle Creek development team gave an update on the status and preliminary design of the deed-restricted, local homes. The project is currently going through the Planning and Environmental Commission and Design Review Board process. The preliminary schedule has site work beginning in October.

EHU Compliance Update
- Staff reported out on the deed-restricted compliance process verification for 2023. A total of 47 properties, or 4.5% of the total 1,034 deed-restricted properties were found to be non-compliant with the terms of the recorded deed restrictions. The next step in the process is to transition from the compliance verification process and begin the enforcement process. Non-compliant files will be turned over to the Vail Police Department for action.

Discussion on Deed Restriction Policy at Timber Ridge
- As a 100% deed-restricted development, a deed restriction shall be recorded for each of the 294 new homes being developed at Timber Ridge Village. The Town Council is supportive of the creation of one form of deed restriction for all homes at Timber Ridge, regardless of the purchaser; and utilizing the Vail InDEED deed restriction form of deed restriction which focuses on occupancy of the home with no price appreciation cap, no income limits and no household size requirements. Council was not in favor of establishing a Vail business owner’s first option to purchase preference. Staff will incorporate Town Council feedback and return on May 7 with a recommended deed restriction for review.

Proposed Safety Measures for July 4th Holiday
- The Vail Police Department is proposing several changes and an outreach campaign to curtail bad behavior, in particular by unaccompanied minors, that has started to crop up on the Fourth of July holiday. This includes deploying additional law enforcement personnel to key locations to deter unruly behavior and collaborate closely with all stakeholders to foster community-wide responsibility for public safety. In addition, proactive outreach to Denver schools by the Vail School Resource Officer will take place, as well as a collaboration with the Eagle County District Attorney’s Office aimed at educating juveniles and holding parents accountable for their child’s actions.

Hanson Ranch Road Update
- In March of this year, staff met with the Town Council to discuss options for reducing congestion on Hanson Ranch Road. Based on those conversations, staff is prepared to implement several changes, including directing all commercial vehicles to pick up and drop off passengers at previously approved locations: Cascade Village, Lionshead Welcome Center, Vail Village Transportation Center, Golden Peak and Checkpoint Charlie. Staff is also recommending that the town no longer use vehicle size to determine where transportation companies can operate, but rather if they are a commercial or private vehicle. In addition to these changes, the police department has identified days that will have mandatory staffing on Hanson Ranch Road. This staffing will be in addition to normal police department staffing and will be funded through our overtime budget. Council was supportive of these changes and a communications effort will be developed.

Planning Application Fee Update
- Staff brought back an updated version of a proposed planning application fee schedule based on previous discussions with the Town Council. Additional feedback included increasing some fees to cover 100% of review costs. Staff will return with a resolution for consideration.

Summer Parking Discussion
- As proposed, summer 2024 parking operations will be generally the same as the previous year, with a recommendation on moving overflow South Frontage Road parking and a program to incentivize carpooling, use of transit and biking to events at Ford Park. Council was supportive of moving overflow South Frontage Road parking away from the front of the Village Parking Structure to the east of Blue Cow Chute. Council would like a more targeted plan for incentives for getting people to use ECO Transit/RTA to get to Vail.

Discussion of Resolution No. 18, Adopting the Town of Vail Public Way Permit Fee Schedule
- Feedback from previous discussions with the Town Council was incorporated into the proposed new fee structure. Council was supportive.

Discussion of Resolution No.19, Update to the Vail Land Use Plan to Amend the Designation of Lot 4, Middle Creek Subdivision
- Council was supportive. As a follow up to the afternoon presentation, councilmember Jonathan Staufer asked that the Town Council pay close attention to the size and scale of a development there.

Discussion of Ord. No. 5, Adopting by Reference the Model Traffic Code for Colorado, 2020 Edition
- Feedback from a previous discussion with the Town Council has been incorporated into the proposed ordinance. Municipal Judge Buck Allen provided his perspective on how the setting of fines should be handled. Council was supportive of the ordinance, with additional information to be considered at second reading.

Discussion of Ord. No. 4, Rezoning a Portion of Lot 4, Middle Creek Subdivision, a Resubdivision of Tract A from General Use and Undesignated to Housing
- Council confirmed that stream protections are in place on this property. Council was supportive.
Actions as a Result of Executive Session
- There were no actions as a result of executive session.
Public Comment
- As part of the planning fee schedule discussion, Galan Asland asked about the equity of Design Review Board fees for smaller projects.
- Jonathan Levine suggested that only commercial vehicles should be allowed to utilize Hanson Ranch Road for passenger drop-off and pick-up.
- Tom Boyd introduced himself as an Eagle County commissioner candidate for District 2.
- Taylor Gardarian asked about a notice from the Town of Vail that could be provided to the U.S. Forest Service indicating the town is not opposed to an assessment of the West Vail Mountain. He also mentioned an energy production process that converts molecular hydrogen to hydrinos.
Town Manager Report
- Town Manager Russell Forrest gave an update on continuing efforts to ensure funding for the entire West Vail auxiliary lane project. Vail and its partners are continuing to push CDOT to prioritize funding for the critical stretch of I-70 known as the “Narrows.” He also gave an update on the status of the council-led strategic plan development process.
