This email is to inform you that the Revised Uniform Law on Notarial Acts has been amended and the changes will go into effect on September 1, 2023. Below is a summary of the changes.

Notarial Certificates 24-21-515, C.R.S. 24-21-514.7(6), C.R.S.
|
- Notaries will no longer need to write their expiration date in their notarial certificate since it is already on their stamp.
- If a notary uses an Interpreter during a remote notarization, the certificate must indicate that the notarial act was performed using an interpreter and include the name and credential or certification number, if any, of the interpreter.

Allowed for non-English speakers
- The interpreter does not need to be certified or apply with the Secretary of State’s office

Allowed for deaf, hard of hearing, and deaf blind community

The interpreter must hold either:
- A valid certification issued by the Registry of Interpreters for the Deaf, Inc. or a successor entity; or
- A valid certification for sign language interpretation approved by the Colorado Commission for the Deaf, Hard of Hearing, and Deafblind.

Interpreter must appear personally before both the notary and signer
- For paper and electronic notarizations, the interpreter must be in the same room as the notary and signer
- For remote notarizations, the interpreter must appear using real-time audio video through an approved Remote Notary Provider

Interpreter cannot have a disqualifying interest
- Interpreter cannot be named in the document
- Interpreter’s family cannot be named in the document
- Interpreter cannot receive a beneficial interest other than the usual payment for interpreter services
- Notarial officer is not liable for a dispute arising from an error in interpretation
- Notary still has an express right to refuse to perform notarization as long as it is not for discriminatory reasons
- SOS does not have the authority to investigate/discipline an interpreter

- If the notary uses an interpreter, the notary must include the full name, address, and certification or credential number (if any) of the interpreter in her journal.

- The next sunset review will be in nine years, September 1, 2032.
