Request for Comment on DRAFT Proposed Emergency Regulations 26-E-04 Concerning A Moratorium on Certain Cancellations and Nonrenewals in Areas Affected by the Aspen Acres Fire

The Division is seeking comments on the following draft proposed emergency regulations:

As of August 5, 2026, the Aspen Acres Fire has grown to almost 102,000 acres burned in Pueblo and Custer counties, with approximately 70% containment. It is estimated that over 200 homes have been damaged or destroyed. The Governor’s declarations of a disaster emergency, together with the extensive damage or destruction of property caused by the fire, make the Aspen Acres Fire a catastrophic disaster under section 10-2-103(1), C.R.S.

This emergency regulation is necessary to provide protections to policyholders in the area impacted by the Aspen Acres Fire. The purpose of this emergency regulation is to protect homeowners insurance policyholders in the affected area who may have their homeowners insurance policies cancelled or nonrenewed in an unfairly discriminatory action by their insurance carrier. Were such cancellations or nonrenewals allowed to proceed, these policyholders could face extreme financial duress without the protections afforded by this emergency regulation. This regulation identifies specific acts or practices regarding cancellations or nonrenewals that may constitute unfair discrimination.

The Division of Insurance finds, pursuant to section 24-4-103(6)(a), C.R.S., that immediate adoption of this regulation is imperatively necessary for the preservation of public health, safety, or welfare of those homeowner policyholders impacted by the Aspen Acres wildfire. Without the protections provided for in this emergency regulation, such homeowner policyholders could have their insurance policies cancelled or nonrenewed at their greatest time of need and could face extreme financial duress should their residence be impacted by the Aspen Acres wildfire. Therefore, compliance with the requirements of section 24-4-103, C.R.S., would be contrary to the public interest.
