Changes to the Commission’s Forms Process
The Real Estate Commission has been promulgating forms for real estate brokers to use since the 1970s. The Real Estate Commission’s Forms Committee (the “Forms Committee”) has existed in some iteration during that time as well. The Forms Committee has been comprised of volunteers from different aspects of the real estate industry – real estate attorneys, real estate brokers, industry educators, and trade association representatives. The Forms Committee has done an amazing job at creating a prolific library of Commission-approved forms for real estate brokers to use in their representation of the public.
After over fifty years of the existing process, the Division of Real Estate identified some concerns with the forms process, which necessitated some changes over the past year. Ultimately, the authority to promulgate the forms, including revisions or new forms, rests with the Real Estate Commission. The Real Estate Commission is also responsible to the public for ensuring that consumers are protected in their dealings with real estate brokers, including ensuring that the contract provisions do not favor licensees over the public. This year, the drafting of the forms transitioned from the Forms Committee to Division staff. We have a licensed attorney who has been reviewing and revising the forms as directed by the Real Estate Commission. The Division engaged experts beyond those on the Forms Committee to assist with different form modifications. The Division’s plan to move forward is to gather more feedback from a variety of experts, and to make the forms process more inclusive than it was previously. The Division will focus on creating plain language forms that are easier for consumers to understand.
Once the Real Estate Commission finishes approving the forms submitted for consideration this year, the Division will host a virtual presentation for interested parties to learn about the changes that will go into effect on January 1, 2026. Unlike a contracts class, this presentation is not designed to train people about how to complete the forms. The presentation will explain the changes that were made and why they were made. The presentation will be free, and the Division is evaluating the ability to provide continuing education credit for those who attend. As the Commission works through its library of forms, Real Estate Brokers will notice some changes to the headers on the forms. The Commission is modifying those to make it easier for licensed professionals to identify when the forms were approved and the effective dates. The Division is adding proprietary language to the Commission-approved forms to protect the intellectual property of the Commission. Finally, forms providers will have to sign a license agreement to distribute the Commission-approved forms across the different software platforms. This will aid the Division in ensuring that the forms providers are using the correct versions of the forms. The Division will continue to provide the forms on its website at:

About the Director: Marcia Waters
Marcia Waters has been with the Colorado Division of Real Estate since August 2005. Ms. Waters started with the Division as a Criminal Investigator for the Real Estate Commission and was promoted to Chief Investigator in 2006. In 2007, she was promoted to the position of Investigations and Compliance Director. In that capacity, she managed the investigatory and settlement programs for the Division. On October 15, 2010, she was promoted to the position of Division Director. The Division of Real Estate licenses and regulates approximately 70,000 real estate professionals. Ms. Waters serves as the administrator for the Real Estate Commission, the Board of Real Estate Appraisers, the Board of Mortgage Loan Originators, and the HOA Information and Resource Center.
Ms. Waters manages the Division’s approximately $9.0 million budget, oversees a staff of approximately 60 full-time employees, and establishes the direction of Division programs based on market and industry trends.

License Renewals Open November 1, 2025
Renewals for all license programs will be open on November 1, 2025, and will remain open until December 31, 2025. Each license program varies based on state law, Board or Commission regulations, and, in some cases, federal law.
Therefore, reviewing the details of your specific program early will ensure that you are able to timely renew and not find yourself in a last-minute rush to complete any required continuing education or submit documents to the Division.
No licensee can conduct business that requires licensure if that license is expired.

Important Notice For Inactive Licensees: If your license is on an inactive status, you must still renew your license if you wish to maintain the inactive status and avoid any applicable reinstatement fees.

Important Renewal Notice For All Existing MLO Licensees
As most Mortgage Loan Originators know, licenses are effective for one year and must be renewed by December 31 of each year. Similarly, most licensees know that the renewal period for the Division of Real Estate is November 1-December 31. Accordingly, the Division is releasing this important information in advance of opening the renewal period.
• Renewals: For all renewals, requests will be submitted to the NMLS only. The renewal fee for your Colorado license will be collected during the NMLS registration renewal and you will not be required to take further action in the Colorado license management system to renew.
• Reinstatement: Should you miss the December 31 renewal deadline and need to reinstate your license between January 1 and the last day of February, all reinstatement requests will be submitted to the NMLS only.
• Initial Applications/Reapplications: For those persons interested in submitting an initial application to become a Mortgage Loan Originator, or for those persons who need to reapply because they did not reinstate their license by the last day of February, submissions in both the Colorado database and the NMLS are required.

Updates to Commission Approved Contracts and Forms
The Colorado Real Estate Commission has approved updates to 21 different contracts and forms, and, importantly, added 2 new forms to its library to better serve licenses and protect consumers in Colorado. These contracts and forms will be found on the Division’s Contracts and Forms webpage after October 20, 2025, in redlined format for educational purposes.
Division staff strongly encourages real estate brokers to familiarize themselves with the changes before January 1, 2026, when these new forms will be required for use in all transactions. Questions on how these changes might affect the practice of real estate should be directed to your employing broker, your supervising broker, your compliance officer, or your legal counsel.

Important Updates to Commission Approved Position Statements
At the October 7, 2025, Colorado Real Estate Commission meeting, the Commission approved two important changes to the Real Estate Broker Position Statements that all real estate brokers should know about.
As background, it is important to remember that Commission Position Statements offer important practice-related guidance to real estate practitioners. Commission Position Statements are not law but should be interpreted as non-binding direction on relevant laws and regulations, including but not limited to the Real Estate Broker Practice Act, sections 12-10-201, C.R.S. et seq. and the Colorado Real Estate Commission Rules, 4 CCR 725-1. On October 7, the Commission approved two changes to its Position Statements:

Commission Position 22: This position statement was amended. Since June 2022, when many of the Commission’s position statements were revised, updated, and reorganized, Commission Position 22 has pertained to Conflicts of Interest. This topic is an issue that Division investigators regularly encounter issues with during investigations, and therefore, understanding this topic is of paramount importance for licensees. Commission Position 22 helps licensees understand what a conflict of interest is and explains that licensees have an obligation to disclose conflicts of interest when they are present.

Commission Position 31: This is an entirely new position statement, and therefore, every licensee should take the time to review it. Commission Position 31 pertains to the management of confidential client information by an employing broker. Competency to practice real estate is essential for every licensee. Nevertheless, many licensees, whether experienced or new to the industry, require the opportunity to consult with a colleague, supervising broker, employing broker, or other professional resource. Commission Position 31 was prepared and adopted by the Commission to provide important guidance to employing brokers for situations where confidential client information is to be shared by a Designated Broker. A Designated Broker is the Broker with whom the Client engages for the performance of licensed brokerage duties, and with whom the Client establishes a Brokerage Relationship.

2025 State Demography Summit on November 7, 2025
The Colorado State Demography Office is presenting a one-day conference to attendees that offers the opportunity to learn about the most current population and economic estimates and forecasts for the state, its regions, counties, and municipalities.
This year, the State Demography Summit will occur on Friday, November 7, 8:30 a.m. to 3:30 p.m., at the Arvada Center, 6901 Wadsworth Blvd, Arvada, CO 80003.
Six hours of Continuing Education Credits will be available to Real Estate Appraisers and Real Estate Agents through the Colorado Division of Real Estate.

There are three types of registration for the 2025 State Demography Summit:
• In-Person Registration: $60.00 per person. Includes Breakfast and Lunch at the Arvada Center. • Live Stream Registration: $30.00 per person for those not employed by the State of Colorado. • Complimentary Live Stream Registration for State of Colorado Employees.

Office of Legislative Legal Services Releases 2025 Laws
In the months following the Colorado General Assembly Legislative Session each year, the Office of Legislative Legal Services diligently works to incorporate all the bills that became law during the legislative session into the Colorado Revised Statutes.
Recently, this task has been completed, and the 2025 version of the Colorado Revised Statutes has been released publicly. Perhaps you are looking for the latest version of the practice act for your license, or a copy of the Colorado Common Interest Ownership Act (“CCIOA”). Free versions are available.

New USPAP Update Course Released For Real Estate Appraisers
On October 2, 2025, The Appraisal Foundation (“TAF”) notified the Colorado Division of Real Estate about the launch of a new 7 Hour National USPAP Update Course. The Uniform Standards for Professional Appraisal Practice, also known as “USPAP”, is a set of minimum national standards by which professional real estate appraisers must adhere.
TAF releases a new 7 Hour USPAP Course every two years; however, in this case, the new course follows an innovative new model that focuses not on changes to USPAP, but on how appraisers can more effectively utilize USPAP in their day-to-day appraisal practice. The Appraisal Foundation Releases the 2026 Guidance and Reference Manual
October 2025 marked the launch of the new 2026 Guidance and Reference Manual, released by The Appraisal Foundation (“TAF”). The Guidance and Reference Manual contains vital information for real estate appraisers on Advisory Opinions (AOs), Frequently Asked Questions (FAQs), and a Reference Index for navigating USPAP® and USPAP®-related questions. Interested parties can purchase a copy in print or digital formats on the TAF website.
Reminder of USPAP Audit
Every real estate appraiser knows of the importance of complying with the standards set forth in USPAP. In addition, every appraiser should know that prior to renewing their license, the Division conducts a USPAP audit on behalf of the Board of Real Estate Appraisers. There is still time to take this essential continuing education course before the end of your current license cycle but first notices of the USPAP audit have already been delivered via email to all renewing appraiser licensees.
In order for your renewal to be available in the Divisions licensing management system, compliance with the USPAP audit is required. If your appraisal license expires on December 31, 2025, and you have not received a notification from the Division regarding how to comply with the USPAP audit, please contact the Division’s appraisal program immediately at the following address:

Time is of the essence! Failure to submit proof of compliance with the USPAP course requirement and renewal by 5:00 pm MT on Friday, December 12, 2025, may result in the following:
• An indication on the Appraisal Sub-Committee’s appraiser license search website that the license has expired • An audit of all 28 hours of continuing education completed during the license cycle • A late renewal penalty fee • Additional fines for any incomplete continuing education

HB25-1043: Colorado HOA Collections and Foreclosures
Has your HOA community adopted the changes set forth by House Bill 25-1043, which is effective October 1, 2025? House Bill 25-1043, a large and comprehensive bill passed by the Colorado legislature during the 2025 legislative session, requires most associations to update their collections policies as well as provide additional information to the Division of Real Estate upon registering or renewing.
