New Board of Mortgage Loan Originators Rules Take Effect
In recent months, the Board of Mortgage Loan Originators has undertaken two separate and distinct rulemaking processes. These rulemaking hearings were held, and the proposed rules were adopted, therefore, changing the rules for Mortgage Loan Originators operating in Colorado. Details about these important rule changes and when they take effect can be found below:
- As discussed in the MLO Advisory below within this Bimonthly Notice from the Division, on July 16, 2025, the Board of Mortgage Loan Originators held a Regular and Rulemaking Hearing to consider changes to MLO Rules 5.7 and 5.8, which relate to the Tangible Net Benefit Disclosure form and requirement. The Board voted to repeal Rules 5.7 and 5.8. Therefore, after September 30, 2025, the effective date of this rule change, licensees no longer need to use the Tangible Net Benefit Form, and the form will be removed from the Division’s website.
- On September 17, 2025, the Board of Mortgage Loan Originators held a second Regular and Rulemaking Hearing. At the hearing, the Board considered public comment in favor of and against the proposed rule changes. After discussion, MLO Rule 4.1 and 4.2 rule changes were adopted. Licensees should understand that these amendments change the requirements for how to renew and reinstate a Mortgage Loan Originator license. BEFORE these rule changes, licensees were required to renew or reinstate in two separate and distinct databases: (a) the State of Colorado database and (b) the NMLS database. AFTER the rule change, licensees should be pleased to know that renewal and reinstatement are only required in the NMLS. These new rules are expected to streamline the renewal and reinstatement processes and save licensees time. These rules are effective for all renewals between now and December 31, 2025, and all reinstatements in 2026.
MLO Advisory: New Rules Governing Mortgage Loan Originators Take Effect September 30, 2025
Mortgage Loan Originators should be aware that on July 16, 2025, the Colorado Board of Mortgage Loan Originators held a Regular Meeting and Rule-Making Hearing. After notice and comment, the Board reviewed Chapter 5: Professional Standards of the rules governing Mortgage Loan Originators, found at 4 CCR 725-3.
During the July 16 hearing, the Board discussed two options: (1) revising the Tangible Net Benefit Disclosure form and when it should be used, or (2) repealing the relevant rules that required Mortgage Loan Originators to provide the Tangible Net Benefit Disclosure form to consumers. The Board voted to repeal Rules 5.7 and 5.8
Importantly, the new rules take effect on September 30, 2025. Therefore, Mortgage Loan Originators should continue to include Rules 5.7 and 5.8 in their practice until September 30, 2025. Thereafter, practitioners are no longer required to use the Tangible Net Benefit Disclosure Form. The form will be removed from the Division’s website when the new rules take effect.
The latest rules for the Mortgage Loan Originators Program, along with the rules governing Real Estate Brokers and Real Estate Appraisers, can be reviewed on the Division’s website. When on that page, select the correct program, and users will be directed to the Colorado Secretary of State’s website for the rules. HOA Center Advisory: Registration Changes Pursuant to Section 38-33.3-401, C.R.S.
Effective October 1, 2025, important changes will be implemented for annual registrations of Common Interest Communities in Colorado.
Section 38-33.3-401, C.R.S. of the Colorado Common Interest Ownership Act (“CCIOA”) states that every unit owners’ association in Colorado must register with the Division of Real Estate and renew on an annual basis. This registration allows the association to enforce a lien for assessments, or to pursue an action, or employ an enforcement mechanism.
In the 2025 General Assembly, the Colorado legislature passed, and the Governor signed HB25-1043. HB25-1043 is commonly referred to as the “Owner Equity Protection in Homeowners' Association Foreclosure Sales” bill. Among other things, this new law requires associations to submit additional information as part of the registration process.
Previously, the HOA Center has directed registrants to be prepared with the following information when initially registering or renewing an existing registration. Those requirements include the following:
1. Legal name of the association as shown with the Colorado Secretary of State's records, 2. Address of the association, 3. Colorado Secretary of State ID number, Date of Incorporation, and Type of Entity (i.e., corporation, LLC) for the association, 4. Type of community (i.e., condominium, planned development, or cooperative) for the association, 5. Number of units located in the community, 6. Whether the association is self-managed or professionally managed, 7. Designated Agent name, address, telephone number, and email address, and 8. Whether the annual revenue collected by the association is more or less than $5000.00.

HOA Center Advisory: HOA Information and Resource Center Website Changes Pursuant to Section 38-33.3-316(10.3), C.R.S.
As mentioned in a previous HOA Advisory, House Bill 25-1043 was passed by the Colorado General Assembly earlier in 2025 and takes effect October 1, 2025. This new law requires most associations in Colorado to update their policies and procedures related to collections.
For purposes of this HOA Advisory, HB25-1043 requires associations that provide a written notice to unit owners about curing any delinquency to inform the unit owner about the availability of, and instructions on how to access free online information through the HOA Information and Resource Center.
The HOA Information and Resource Center, in accordance with House Bill 25-1043, has added information to its website related to obtaining credit counseling for those who may be facing foreclosure, as well as more general information about the consequences of foreclosure by an association.
The HOA Information and Resource Center has prepared a useful website where this information can be located. Since the new law requires written notification to unit owners, board members, and Community Association Managers might consider providing a link directly to this information on the HOA Information and Resource Center’s website. It is important to note that the HOA Information and Resource Center does not provide credit counseling or housing counseling. Rather, the information provided by the HOA Center is designed to route consumers to appropriate resources and organizations that do provide the intended services.

Important Reminder for All Renewing Appraiser Licensees
Each year, renewing appraiser licensees are required to submit a certificate for a 7-Hour National USPAP Update course that was completed between January 1, 2024, through December 31, 2025, as a condition of license renewal. Please note that the 15-Hour National USPAP course cannot be used as a substitute for the 7-Hour National USPAP Update Course.
In addition, to ensure business continuity and avoid any license renewal delays, it is recommended that licensees apply for license renewal as soon as possible and no later than Friday, December 12, 2024, to allow sufficient time for processing and to avoid a lapse in licensure. Renewal applications received after December 16, 2024, and prior to January 31, 2025, may be subject to the following:
• An indication on the Appraisal Sub-Committee’s appraiser license search website that the license has expired • An audit of all 28 hours of continuing education completed during the license cycle • A late renewal penalty fee • Additional fines for any incomplete continuing education
All appraiser licensees subject to this requirement will receive email notifications from the Division about this process; therefore, ensure your contact information with the Division is up to date in eLicense, the Division’s license management system. HB25-1043: Colorado HOA Collections and Foreclosures
Has your HOA community adopted the changes set forth by House Bill 25-1043, which is effective October 1, 2025?
