Notice of Stakeholder Meeting: Board of Mortgage Loan Originators
The purpose of this Stakeholder Meeting is for the Board to receive feedback on proposed changes to Board Rules 4.1 Renewal for Mortgage Loan Originators and 4.2 Reinstatement for Mortgage Loan Originators. The proposed changes to the rules and the September 17, 2025, Notice of Hearing can be viewed on the Division’s website.

What is this about?
The purpose of this Stakeholder Meeting is to allow stakeholders an opportunity to provide feedback on the proposed rule revisions as listed above. In summary, the Board will be considering changes to the rules pertaining to license renewals and reinstatements so that mortgage loan originators no longer have to renew or reinstate their licenses in two databases. The revised rules would only require mortgage loan originators to renew or reinstate through the NMLS.
Why does the Board need my help?
The Board is considering multiple changes to the Rules. We are seeking your expertise and feedback to: 1) help identify how these proposed changes might affect consumer outcomes, positive or negative; and 2) identify any additional rule revisions that should be considered.
How do I submit my comments, and what is the deadline?
We will hold a virtual Stakeholder Meeting on September 3, 2025 at 10:00 A.M. (MDT). Oral comments will be taken from participants who are present via webinar. If you cannot attend the meeting virtually or wish to make written comments rather than speaking, you may email your written comments to marcia.waters@state.co.us. Please submit written comments as soon as possible, to be included in this Stakeholder Meeting.
Will my comments become part of the official record for rulemaking?
Your written and oral comments will be publicly available, and provided to the Board before the Board considers permanent adoption of any proposed revisions to the rules.

Division Legislative Summaries For The 2025 Legislative Session
As a licensee, do you know the latest from the Capitol? What happened in the Colorado 75th General Assembly Legislative Session earlier this year? Over the course of four months, the legislature passed and the Governor signed many bills that affect the real estate industry.

Importantly, the Governor called a special session which started on Thursday, August 21, 2025. Division staff will stay tuned and update licensees about any new legislation passed affecting their practice.

MLO Advisory: New Rules Governing Mortgage Loan Originators Take Effect September 30, 2025
Mortgage Loan Originators should be aware that on July 16, 2025, the Colorado Board of Mortgage Loan Originators held a Regular Meeting and Rule-Making Hearing. After notice and comment, the Board reviewed Chapter 5: Professional Standards of the rules governing Mortgage Loan Originators, found at 4 CCR 725-3.
During the July 16 hearing, the Board discussed two options: (1) revising the Tangible Net Benefit Disclosure form and when it should be used, or (2) repealing the relevant rules that required Mortgage Loan Originators to provide the Tangible Net Benefit Disclosure form to consumers. The Board voted to repeal Rules 5.7 and 5.8
Importantly, the new rules take effect on September 30, 2025. Therefore, Mortgage Loan Originators should continue to include Rules 5.7 and 5.8 in their practice until September 30, 2025. Thereafter, practitioners are no longer required to use the Tangible Net Benefit Disclosure Form. The form will be removed from the Division’s website when the new rules take effect.
The latest rules for the Mortgage Loan Originators Program, along with the rules governing Real Estate Brokers and Real Estate Appraisers, can be reviewed on the Division’s website. On that page, select the correct program, and users will be directed to the Colorado Secretary of State’s website for the rules. HOA Center Advisory: Understanding the HOA Registration Requirement
The HOA Information & Resource Center is commonly asked whether a particular type of community – such as a property owners’ association, a road association, or a voluntary association - is required to be registered with the Colorado Division of Real Estate. While the HOA Center is unable to offer legal advice, the following information is intended to provide guidance for board members, homeowners, and others in the common interest community industry as they seek to understand the state’s registration mandate.
First, the abbreviation “HOA” means “homeowners’ association”. Many understand an HOA to be a community governed by a volunteer board of directors. The directors, or “board members”, are charged with protecting and maintaining the common elements, collecting assessments, paying the bills, and ensuring the continuous and harmonious operation of the community.
The abbreviation “HOA” is not legally defined in the Colorado Common Interest Ownership Act (“CCIOA”) – nor in any other state law or provision. Rather, CCIOA defines the term “Common Interest Community” (“CIC”). Let’s take a closer look at this term and what it means with respect to registering an HOA in Colorado.
CCIOA defines a CIC as “real estate described in a declaration with respect to which a person, by virtue of such person's ownership of a unit, is obligated to pay for real estate taxes, insurance premiums, maintenance, or improvement of other real estate described in a declaration.” See 38-33.3-103(8), C.R.S.
