New legislation Notice: House Bill 25-1053 Becomes Law
As the 2025 legislative session approaches its final days, several bills have already been signed into law. In the coming weeks, the Division of Real Estate will continue to monitor progress in the Colorado General Assembly, but this article is to discuss one of the many bills introduced during the 2025 legislative session which has been signed into law by the Governor of Colorado.
Many would agree that emergency personnel, such as fire, police, and emergency medical providers, require adequate resources and access to land to provide emergency services in a variety of situations. In doing so, certain landowners have expressed concerns about potential liability for granting access to land in furtherance of emergency personnel providing these services.
HB25-1053, signed into law on March 20, 2025, directly addresses these concerns. The new law states that a landowner, who is acting in good faith and without compensation, grants access to the landowner’s property in connection with an emergency, shall be immune from civil liability for damage to persons or property.
The protection is not without limitation as the law does not protect a landowner from acts or omissions that are grossly negligent, nor does the law protect from willful and wanton behavior.

But there is an important question: What is an emergency? The law defines an Emergency as:
- A fire, rescue call, or hazardous materials incident;
- A natural or human-caused disaster such as an earthquake, wildfire, flood, or severe weather event; or
- An incident reasonably determined to be an emergency by a first responder.
See section 13-21-108.9(1)(a), C.R.S.
Because this law will take effect later this summer (90 days following the adjournment of the general assembly), landowners, property managers, and common interest communities should be aware of this new law and the protections granted to them by the law. With the threat of wildfires, extreme weather, and other emergencies on the rise, understanding the law and the rights and protections conveyed by HB25-1053 is important.

In Brief: Live Online Continuing Education Classes Reminder
Over the last few years, the Division of Real Estate has observed a large increase in the number of real estate licensees that rely on Live Online continuing education courses to satisfy their education requirements.
There are many merits to the various formats of continuing education courses available to licensees. For example, many live in-person classes allow for networking with fellow professionals and interacting with the instructor before, during, and after the course. On-Demand courses and Live-Online courses allow the student to learn important skills and knowledge from the comfort of their home or their office.
Despite the many merits, the Division would like to take an opportunity to remind licensees that to be eligible for continuing education credit when attending a live on-line course, licensees must:
• Register for the course with your full name, as it appears on your license
• Login to the course with your full name, as it appears on your license
• Have and maintain an active video feed for the duration of the course
• Ensure your face is in full view for the duration of the course
• Ensure that you are an active participant throughout the course
Being an Active Participant means that the student is engaged in the material and is not distracted or multitasking. By analogy, active participation for a live online course is like attending a live course. In a live course setting, students are alert and not talking on the telephone, traveling, running errands, or taking mid-lesson breaks during the class. All licensees should understand that failure to comply with the Division’s expectations may result in denial of continuing education credit for a course.
