News Release - Colorado Real Estate Commission To Treat License Surrender As A Revocation After Detailed Investigation
DENVER, COLORADO-On August 7, 2024, the Colorado Real Estate Commission (the “Commission”), after a long and detailed investigation, entered into a Stipulation and Final Agency Order with licensee MV Realty of Colorado, LLC, License Number EC.100089583, for license surrender, fines, and public censure. Stemming from various complaints and concerns received by investigators with the Division of Real Estate (the “Division”), part of the Department of Regulatory Agencies (“DORA”), the Commission found that objective and reasonable grounds existed to believe that MV Realty of Colorado, LLC disregarded or violated license law and rules.
The registered principal office address of MV Realty of Colorado, LLC is 1451 W Cypress Creek Rd, Ste. 300, Fort Lauderdale, Florida 33309. MV Realty of Colorado, LLC’s registered agent in the State of Colorado is CT Corporation System, with a registered agent address of 7700 East Arapahoe Rd., Ste. 220, Centennial, Colorado 80112.
At a public meeting of the Commission on August 2, 2022, the Commission unanimously voted to revoke the license. Since that time, the Division pursued a resolution and, in due course, obtained a license revocation in less time than in a judicial proceeding. Concurrently, Division staff has worked diligently to protect the public from further victimization by educating licensees regarding the alleged behavior and various media outlets have covered the impermissible behavior. The Colorado General Assembly has also acted by passing a bill which, on April 3, 2023, Governor Polis signed. Senate Bill 23-077 became law prohibiting the inclusion of certain terms in a broker contract. (Read More)

News Release - Colorado Real Estate Commission To Accept the Surrender of Licensee Involved in Personal Property Auctions
DENVER, COLORADO-On September 20, 2024, the Colorado Real Estate Commission (the “Commission”) entered into a Stipulation and Final Agency Order with licensee, Rachelle Marie Paplow, License IL.100035926, for license surrender and public censure. The Division of Real Estate (the “Division”), part of the Department of Regulatory Agencies (“DORA”), conducted a detailed investigation and found evidence of misconduct and license law violations by the licensee. Pursuant to the Stipulation and Final Agency Order, the licensee admitted to the Division’s factual findings and violations of real estate licensing law and/or Commission rules.
The licensee operates as an individual proprietor under the name Denver Lifestyle and Luxury Homes, Inc. The licensee’s registered principal office address with the Division is 6380 South Boston St., Ste. 113, Greenwood Village, Colorado 80111. The registered agent of Denver Lifestyle and Luxury Homes, Inc. is Rachelle M. Paplow, and the registered agent address is 13706 East Weaver Ave., Centennial, Colorado 80111.
As a result of the Division’s investigation, the licensee has stipulated to surrender their license. In addition, § 12-10-217(1), C.R.S. permits the Commission to treat this surrender as a license revocation. The surrender was effective immediately on September 20, 2024, and as of that date, the licensee is not permitted to perform any duties that require a real estate license. (Read More)

HOA Center Advisory -Announcement About Senate Bill 24-021
HOA interested parties might want to know about an important bill that became law on August 7, 2024. Senate Bill 24-021 requires the HOA Information and Resource Center to notify cooperatives and planned communities (1) about the enactment of Senate Bill 24-021 and (2) that cooperative and planned communities may elect to be subject to the entirety of the Colorado Common Interest Ownership Act (“CCIOA”) by adopting an amendment to their declaration.
In early September, the HOA Center delivered a message to associations to inform those associations of Senate Bill 24-021. You can review that notice here.
Whether you are a unit owner, board member, Community Association Manager, or licensed Colorado attorney, you might want to review the bill and determine if your association, or any association that you are associated with qualifies pursuant to the law.

HOA Forum: HOA Budgets
With the end of the 2024 calendar year quickly approaching, it is time for many Common Interest Communities in Colorado to consider their budgets for the next year. While many associations hold their budget meeting at the same time as an annual unit owners’ meeting, not all do. Either way, in preparation of your community’s budget process, you are invited to join the HOA Information Officer to learn more about what the Colorado Common Interest Ownership Act (“CCIOA”) says about budgets and the budgeting process. All are welcome to attend.
On Friday, October 25, 2024 at 1:00 pm (MT), join the HOA Information Officer for a live presentation and Q&A. Members of the public are encouraged to submit their questions in advance to dora_dre_hoainquiries@state.co.us.
