Colorado Real Estate Commission To Accept the Surrender of Licensee Involved in Personal Property Auctions
DENVER, COLORADO-On September 20, 2024, the Colorado Real Estate Commission (the “Commission”) entered into a Stipulation and Final Agency Order with licensee, Rachelle Marie Paplow, License IL.100035926, for license surrender and public censure. The Division of Real Estate (the “Division”), part of the Department of Regulatory Agencies (“DORA”), conducted a detailed investigation and found evidence of misconduct and license law violations by the licensee. Pursuant to the Stipulation and Final Agency Order, the licensee admitted to the Division’s factual findings and violations of real estate licensing law and/or Commission rules.
The licensee operates as an individual proprietor under the name Denver Lifestyle and Luxury Homes, Inc. The licensee’s registered principal office address with the Division is 6380 South Boston St., Ste. 113, Greenwood Village, Colorado 80111. The registered agent of Denver Lifestyle and Luxury Homes, Inc. is Rachelle M. Paplow, and the registered agent address is 13706 East Weaver Ave., Centennial, Colorado 80111.
As a result of the Division’s investigation, the licensee has stipulated to surrender their license. In addition, § 12-10-217(1), C.R.S. permits the Commission to treat this surrender as a license revocation. The surrender was effective immediately on September 20, 2024, and as of that date, the licensee is not permitted to perform any duties that require a real estate license.
When discussing the Stipulation and Final Agency Order, Division Director Marcia Waters stated in unequivocal terms that “Colorado consumers expect licensed professionals to understand and comply with all applicable laws and regulations. Specifically, this includes accounting for and timely remitting any monies in his, her, or their possession that belong to others. Licensees are expected to engage the public in a transparent and honest manner and effectively communicate with the public at all times.”
The Division has limited jurisdiction in these matters and is statutorily mandated to enforce license law against real estate licensees. The Division is unable to divulge any information concerning an investigation. Furthermore, investigative files are closed to public inspection pursuant to statute. The Division does not have any authority or power to seek civil restitution for any damages or monies on behalf of consumers.
