Notice of Adoption - Amended Bulletin B-1.6 and New Bulletins B-1.38 and B-4.142

The Division would like to provide notice that the Commissioner has adopted the following bulletins:

The Division of Insurance (Division) maintains many records that fall within the purview of
Colorado’s open records laws, §§ 24-72-201 to 710 C.R.S. This bulletin outlines when and how such records may be inspected; provides the fees associated with the copying of those records; and provides the fees associated with any research, retrieval, review or production of requested records.

The bulletin is being amended based a recent memo by Legislative Council Staff regarding Colorado Open Records Act Maximum Hourly Research and Retrieval Fee.

The purpose of this bulletin is to provide information as to which bulletins are being
withdrawn, as after review it has been determined that they are no longer necessary due to subsequent legislation, promulgation of regulations, and more recent issued guidance.

The purpose of this bulletin is to provide guidance on the revised definition of Short-Term Limited Duration Insurance (“STLDI”) as set forth in 89 Fed. Reg. 23338-01, “Short-Term, Limited Duration Insurance and Independent, Noncoordinated Excepted Benefits Coverage,” published on April 3, 2024, by the Department of Labor, Department of the Treasury, and Department of Health and Human Services. The revised definition of STLDI was codified at 45 C.F.R.§ 144.103, effective June 17, 2024. This bulletin also addresses the notices that must be used as defined in 45 C.F.R. § 144.103 and § 10-16-102(60), C.R.S.
