Alternative Financing For Real Estate Transactions
An important and frequently discussed section of the 2024 Annual Commission Update course (the “ACU”), the required annual course for all real estate brokers, pertains to alternative types of financing. There are several reasons for this section being included in the 2024 ACU including, but not limited to: (1) the complicated interchange between broker licensure, mortgage loan origination, and legal advice, and (2) the increased occurrence of these transactions resulting from various market conditions.
The Division has received both inquiries and complaints from across the State about offers that include alternative financing. In addition to conventional, VA, and FHA financing, there are several different types of alternative financing that practitioners should familiarize themselves. Alternative financing might include “Subject To” financing, wraparound financing, seller financing, installment land contracts, and loan assumptions. This article will briefly describe each. February Meetings: Metropolitan District Homeowners’ Rights Task Force
The Metropolitan District Homeowners’ Rights Task Force, created by HB23-1105, will hold a two public meetings in February 2024. The first will be on Monday, February 5, 2024 and the second will take place on Monday, February 26, 2024. Both meetings will be via webinar only and be held from 2:00 P.M. until 4:00 P.M. (MT).
The Metropolitan District Homeowners' Rights Task Force is created in the Department of Regulatory Agencies by section 24-34-101(1)(a), C.R.S. to examine issues confronting communities that are governed by the executive board of a Metropolitan District.

The HOA Homeowners' Rights Task Force will hold two public meetings via Webinar in February. The first will be Friday, February 2, 2024 and the second meeting will take place on Tuesday, February 13, 2024. Both meetings will be via webinar only and be held from 1:00 P.M. until 4:00 P.M. (MT).

Sunset Review of the Colorado HOA Information and Resource Center
The Colorado Office of Policy, Research and Regulatory Reform ("COPRRR") is currently conducting a sunset review of the Colorado HOA Information & Resource Center. Analysis is performed to determine if the Resource Center is necessary and should be continued, modified, or repealed. To provide input on this review, please visit COPRRR's website.
