Commission Approved Real Estate Forms For Use After January 1, 2024
Each year, the Colorado Real Estate Commission reviews and updates approved contracts and forms to comply with the latest laws and practices in the real estate industry. On January 1, 2024, the Division of Real Estate released several updated forms for use in Colorado. For those licensees that had listings as of December 31, 2023, new forms like the Seller's Property Disclosure must be used on any property that goes under contract on or after January 1, 2024. It is important that all real estate licensees familiarize themselves with the new forms and implement them in their practice.
Reminder: Renew Your License Today!
The Division of Real Estate is taking one last opportunity to remind all licensees about license renewal. Licensees with an expired license MAY NOT conduct any business that requires licensure. If you have not already, visit the Division of Real Estate's website now to renew your license.

Sunset Review of the Colorado HOA Information and Resource Center
The Colorado Office of Policy, Research and Regulatory Reform ("COPRRR") is currently conducting a sunset review of the Colorado HOA Information & Resource Center. Analysis is performed to determine if the Resource Center is necessary and should be continued, modified, or repealed. To provide input on this review, please visit COPRRR's website.

Errors & Omissions Insurance Policy Renewal Reminder
The Division would like to remind all active licensees that many Errors & Omissions ("E&O") policies expire on January 1, 2024, please review important renewal information prepared by the state contracted E&O carrier, Rice Insurance Services Center (RISC).
Most E&O policies expire on January 1, 2024. Please be advised that a full E&O audit of Real Estate Brokers will take place in February, 2024 to ensure compliance with the E&O insurance requirement.
If you are renewing a policy that expires on January 1, 2024, you must purchase the renewal before January 31, 2024 and the policy must be effective January 1, 2024 to be considered compliant.

Metropolitan District Homeowners’ Rights Task Force - January Meetings
The Metropolitan District Homeowners’ Rights Task Force, created by HB23-1105, will hold a two public meetings in January 2024. The first will be on January 8, and the second will take place on January 22. Both meetings will be via webinar only and be held from 2:00 P.M. until 4:00 P.M. (MT).
The Metropolitan District Homeowners' Rights Task Force is created in the Department of Regulatory Agencies by section 24-34-101(1)(a), C.R.S. to examine issues confronting communities that are governed by the executive board of a Metropolitan District.

HOA Homeowners' Rights Task Force January Meetings
The HOA Homeowners' Rights Task Force will three public meetings via Webinar in January. On Tuesday, January 2, 2024 from 1:00 P.M. until 5:00 P.M. (MT) there will be time given to hear public testimony. On Tuesday, January 16, 2024 from 1:00 P.M. until 4:00 P.M. (MT), the task force will hold a second meeting. Then, on Tuesday, January 30, 2024 from 1:00 P.M. until 4:00 P.M. (MT), the task force will hold a third January meeting.

HOA Forum: Association Records and Annual Disclosures
Happy New Year! Even in 2024, many associations still operate as if it is the year 1983 with respect to making certain records available to unit owners. Is your HOA in compliance with House Bill 12-1237, which was made law over a decade ago? As a board member, do you know which records must be withheld from production to unit owners? What about those pesky annual disclosures mandated by the Colorado Common Interest Ownership Act (“CCIOA”)? Ensure your association is not stuck in the age of the first spacewalk by attending the HOA Information & Resource Center’s HOA Forum on Association Records and Annual Disclosures.

HOA Advisory: The New Year Is A Great Time To Check On Your Registration Status
The Colorado Common Interest Ownership Act (“CCIOA”) requires that all associations located in Colorado to register with the Division of Real Estate and renew on a yearly basis. The HOA Center is commonly asked if failure to register invalidates an association. It does not but it does result in suspending the association’s legal right to enforce a lien for assessments, pursue an action, or employ an enforcement mechanism. For more detailed information on association registration, please see section 38-33.3-401, C.R.S.
The HOA Information & Resource Center has developed a detailed website that sets forth the step-by-step directions for the registration process, renewal process, and other changes that an association can make in the registration system. For more information, you can visit the HOA Center’s Registration Services Help Page. Board members should regularly ensure that the contact information for the association’s registration is current. This is most helpful because the HOA Center will issue renewal notices by email approximately one (1) month before the expiration. (Read More)
