Request for Comment on DRAFT Proposed New Regulation 5-1-XX Concerning Tolling Certain Time Limits of Policyholder Benefits in the Event of a Catastrophic Disaster

The Division is seeking comments on the following draft proposed new regulation:

The purpose of this regulation is to protect homeowner policyholders, who have suffered a total loss during a catastrophic disaster, from insurers that cause unreasonable delays in claim handling, which may further delay rebuilding property. Further, this regulation identifies specific acts or practices that may constitute unfair claim settlement practices.

A previous version of this draft regulation was circulated for comment on November 4, 2021. This redlined version reflects changes to the regulation based on the comments received.
