State Board of Pharmacy Adopts Emergency Rules - Effective 5/1/20

On April 30, 2020, the State Board of Pharmacy adopted Emergency Rule 30.00.00  as part of the implementation of Executive Order D 2020 038, which expands the workforce of trained medical personnel available to provide healthcare services within inpatient facilities and out-patient pharmacy settings. By temporarily suspending several current Rules related to satellite pharmacy locations, the new Emergency Rule 30.00.00 ensures hospital pharmacies are able to meet expanding patient needs during the pandemic. Additionally, Emergency Rule 30.00.00 amends and creates new requirements in certain rules. Emergency Rule 30.00.00 goes into effect May 1, 2020, and will be in effect for no longer than 120 days.

 Specifically, Emergency Rule 30.00.00 affects the following requirements: 

  • Maximum 1-mile distance restriction between the primary hospital pharmacy and the hospital satellite pharmacy

  • Pre-registration inspections for hospital satellite pharmacies 

  • Technical and space requirements (i.e. requirements for sinks and reference materials) for hospital satellite pharmacies

  • Minimum hours of operation for both hospital satellite pharmacies and all other Colorado-based pharmacies

  • Security requirements for hospital satellite pharmacies    

  • Qualifications to participate in drug therapy management

  • Consultant pharmacist visitation requirements in Other Outlet settings 

  • Qualifications for collaborative pharmacy practice

  • Qualifications to administer vaccines

  • Sterile compounding and shortage of garbing supplies, as well as beyond-use dating for sterile products based on updated guidelines provided by the United States Pharmacopeia 

  • Remote pharmacy practice

  • Pharmacy technician certification and provisional certification

Please Note: During the 120-day time frame, the Emergency Rule 30.00.00 amendments to Board Rules 21.00.00 and 26.00.00 will supercede applicable language that still exists in the current version of those two rules.
