Notice of Termination of Rulemaking Hearing for Proposed New Regulation 4-2-71 - Concerning Strategies to Enhance Health Insurance Affordability

The Division would like to provide notice that the Division of Insurance in the Department of Regulatory Agencies has terminated the rulemaking process for the new proposed rule 4-2-71: Concerning Strategies to Enhance Health Insurance Affordability.

The proposed regulation was intended to implement the Commissioner's authority to consider, as part of the annual rate review process, whether a carrier has implemented effective strategies to enhance the affordability of its products. It included a primary care investment requirement and an alternative payment model implementation requirement. The rulemaking hearing scheduled for April 14 will be canceled, and the Secretary of State’s website filing will be updated to reflect this.

The Division is terminating this proposed regulation due to the ongoing COVID-19 emergency, and the subsequent need to provide maximum flexibility and support at this time for health care providers, insurance carriers, and others impacted by COVID-19. We are extremely grateful for the work of the Primary Care Payment Reform Collaborative to date- and for the extraordinary efforts providers, insurance carriers, and others are now making to care for patients and manage a difficult situation. The Division is committed to supporting these efforts and providing regulatory flexibility where possible during this crisis. 

Ensuring that health care is affordable remains one of the Division’s top priorities. We will continue to implement HB19-1233, through the Primary Care Payment Reform Collaborative’s work, and are committed to future progress on health care affordability standards. Additionally, Colorado’s reinsurance program enacted by HB19-1168 will continue as planned in 2020, making health insurance more affordable for those who purchase insurance on the individual market.
