House Bill 19-1174 Surprise Billing Sample Disclosure Form Available

Greetings from the Division of Professions and Occupations,

On May 14, 2019, Governor Jared Polis signed House Bill 19-1174 Out of Network Healthcare Services. The bill includes provisions for how health insurance carriers will reimburse providers (doctors, hospitals and other health care providers) for out-of-network emergency and non-emergency care. The new law also requires healthcare providers to develop and provide  consumer disclosures about the potential effects of receiving emergency or non-emergency services from an out-of-network provider, and the possibility of “surprise/balance billing.” The disclosure forms must comply with the rules adopted by the Director of the Division of Professions and Occupations.

The new law went into effect on January 1, 2020, and the Director adopted rules accordingly regarding the new requirements. The new rules include a sample disclosure form for the following Programs:

  • Office of Acupuncture Licensure
  • Office of Athletic Trainer Licensure
  • Office of Audiology Licensure
  • Office of Direct-Entry Midwifery Registration
  • Office of Hearing Aid Provider Licensure
  • Office of Massage Therapy Licensure
  • Office of Naturopathic Doctor Registration
  • Office of Occupational Therapy
  • Office of Respiratory Therapy Licensure
  • Office of Surgical Assistant and Surgical Technologist Registration
  • Office of Speech-Language Pathology Certification.
