Important Update: Community Association Manager (CAM) Licensing Program and Homeowners’ Associations (HOA) Stakeholder Input

On Friday, May 31, 2019, the Governor vetoed HB19-1212 (Recreate Homeowners' Association Community Manager Licensing Bill).

As a result of this veto, the CAM licensing program will end at the Division of Real Estate on June 30, 2019, and the Division will no longer have any jurisdiction over community association managers. The Division will cease to enforce any licensing, investigations, insurance, and continuing education requirements regarding this program.

What happens next?

As per the Governor’s Executive Order, the Department of Regulatory Agencies (DORA), through the Division of Real Estate (Division), will conduct a comprehensive review of existing and potential laws and recommend strategies to promote effective and efficient regulation of Community Association Managers (CAMs) and Homeowners’ Associations (HOAs).

Specifically, the Governor has requested information and recommendations on the following:

  1. The licensure of CAMs, and whether licensure is needed to protect consumer safety and is cost-effective;
  2. Approaches that improve transparency among HOAs;
  3. Methods to reduce costs and improve the transparency of HOA fees and fee schedules; and
  4. Strategies to promote homeowner rights and consumer protections through an evaluation of the Colorado Common Interest Ownership Act and other related acts or rules.

The Division will be sending out a survey on the topics referenced above so that it can receive your input and recommendations. This information will be used as a basis for discussion at the stakeholder meetings.  

In the months of August, September and October, interested stakeholder meetings will be conducted at the DORA offices. Interested parties will be able to attend in person, however, attendee space will be limited due to the room size, so the Division is also making these meetings available for viewing by Webinar from your computer.

It is important if you have any input for the Division to consider for its report to the Governor’s office that you provide your input, suggestions and recommendations in a timely manner so that they can be collected, compiled and considered prior to the Division finalizing the proposed recommendations for the Governor.
