Court of Appeals Decision on Rehabilitation Properties
The court of appeals announced their decision in HCPI/CO Springs Ltd. Partnership, Petitioner-Appellee, v. El Paso County Board of Commissioners, Respondent-Appellant – Case No. 2024COA82, on August 2, 2024. The court reversed the Board of Assessment Appeals (BAA) determination in favor of HCPI/CO Springs Ltd. Partnership, and remanded the case back to the BAA for further proceedings consistent with this opinion.
The court concluded that the BAA’s decision to classify the rehabilitation hospital as residential property is contrary to law because a rehabilitation hospital is designed for use predominantly to provide rehabilitative services and not as a place of residency.
The petitioners requests for a rehearing with the court of appeals and writ of certiorari with the Supreme Court were denied. The Assessor Reference Library will be updated and presented at the June 12, 2025 Statutory Advisory Committee meeting.
