 May Spotlight: FAMLI premiums going down, benefits going up under new Colorado law
Colorado employers like you can take credit for a big win on FAMLI premiums and benefits.
A new law lowers premiums for employers and workers to 0.88% of wages and adds a whole new category of FAMLI leave, for new parents with a newborn being treated in a hospital’s neonatal intensive care unit.
The changes take effect in January. Premiums for Colorado’s paid-leave fund are split among employers and workers in Colorado and are currently set to 0.9% of wages, due quarterly.
The premiums reduction makes coverage even more affordable for Colorado workers to take the time they need during critical life events – and for employers to help them do so. According to projections from state fiscal analysts, the change will save Colorado workers and employers some $35 million next fiscal year.
The new law also gives the FAMLI Division additional tools to manage premiums and avoid volatility from year to year.
“We’re proud to say Colorado trusts the FAMLI Division to both protect parents and this fund,” said FAMLI Division Director Tracy Marshall. “We’ll continue to make the necessary adjustments to keep this essential safety net on solid financial footing.”

Average Weekly Wage & What It Means For You
FAMLI is designed to adapt alongside Colorado’s economy, ensuring workers get the support they need while keeping costs stable and predictable for employers like you.
Earlier this month, the Director of the Colorado Division of Workers' Compensation issued the Maximum Benefits Order for 2025-2026. In it, the 2025-26 state average weekly wage (SAWW) was determined to be $1,534.94. This means that, effective July 1 of this year, the weekly FAMLI benefits max will increase to $1,381.45.
What this means for your business: Covered employees will have access to slightly higher paid leave benefits — while your employer premium rates remain exactly the same. And in even better news, because of SB25-144, employees will enjoy this increase even as your premium payments decrease starting January 2026.
This annual adjustment ensures Colorado’s paid leave program remains strong, responsive, and aligned with our growing economy — all while keeping the cost of business stable for employers.

It’s the end of June, which means the Q2 2025 reporting deadline is fast approaching. Employers, stay ahead of the game and get your Q2 wage reports and corresponding premiums payments in by Thursday, July 31, 2025.
