Proposed rule amendments: Join the conversation and share your voice!
The FAMLI Division has recently submitted a set of proposed amendments, filed on September 15, 2023. We're inviting you to a virtual public hearing scheduled for October 17, 2023, starting at 4:30 p.m. via Zoom. The hearing will conclude after hearing from all interested participants.
To share your input, please RSVP by completing this form.
Alternatively, you can submit written comments using our public comment form. The comment period for the proposed rule amendments will close on October 18, 2023, at 9:00 a.m.

Did you miss our September live webinar?
ICYMI: Our latest live webinar was held on September 13, for all self-employed workers and employees of local governments who have opted out. We covered the newly proposed rules that will impact voluntary participants and previewed the process for how these individuals will need to report income and pay premiums in order to access FAMLI benefits once they become available in 2024. This was followed by a Live Q&A session.

Q: What if the need for leave is unforeseeable or submitting in advance is impractical?
If the need for leave is unforeseeable or applying in advance isn't feasible, applications can be submitted up to 30 days after the leave has begun. If an application is received within 30 to 90 days, it will still be considered if there's evidence of a good reason for the delay.
Q: When are FAMLI benefits issued and how are they paid?
FAMLI benefit payments become available in January 2024. FAMLI benefits are not issued before the first day of absence and are typically paid in arrears, going back to the first day of absence. The first benefit payment is made after a total absence of at least eight hours. Payments are issued weekly, although biweekly payments are allowed by statute. There's no waiting period before FAMLI leave becomes effective. Claimants can choose to be paid via a direct deposit or on a pre-paid debit card.
Q: Is there a minimum work requirement to be eligible for FAMLI benefits?
No, claimants do not need a minimum number of days working for a single employer to be eligible for benefits. However, employees must have worked with the same employer for at least 180 days (around six months) in order to receive job protection when taking FAMLI leave. Eligibility is determined by looking at an individual’s wages from the previous five quarters. Claimants must have earned at least $2,500 in Colorado during that time.
