Welcome to the monthly newsletter for Colorado’s new paid Family and Medical Leave Insurance (FAMLI) program. If you’re receiving this newsletter for the first time, you have an account in My FAMLI+ Employer and this newsletter includes important information for your business. Each FAMLI newsletter aims to assist employers and third party administrators in meeting their FAMLI requirements. It also contains information for health care providers, individuals and families about the launch of FAMLI benefits in 2024.
These updates can also be sent directly to your cell phone, just add your mobile number to your subscription preferences and select SMS/text message as your preferred format.

Q2 Reporting Deadline for Employers: July 31, 2023!
The clock is ticking! Just a few days remain for employers to report Q2 wage reports and corresponding premium payments. It’s all due by Monday, July 31, 2023. If you miss the deadline, your business will be charged late fees and interest on past-due payments. If you still haven’t completed your Q1 reporting requirements, get it done as soon as possible, so those fees and interest payments don’t pile up. Need help getting it all done? Check out our How-To-Videos, user guides, file specifications, and sample templates for help. And if you need individualized support, call 1-866-CO-FAMLI (1-866-263-2654) Monday through Friday between 8 a.m. and 4 p.m.

Wage Rules are Changing!
One of the basic foundations of how FAMLI is funded – the wages that count when calculating premiums – is changing. And we want to know what you think about it.
Join us (virtually) for a public Rules hearing August 1, 2023, at 10:15 a.m. Get the full details of the proposed changes here. In addition to the proposed change on wage calculation, there is a proposal to modify the requirements for Local Governments.
We encourage all members of our community, employers and families alike, to give these proposals some thought and submit any questions or concerns before they are adopted! Here’s how:
The public comment period is now open. To submit a written public comment on the proposed rule changes, please fill out our Submit A Public Comment form.
The meeting on Aug. 1 won’t end until the last person who wishes to speak has been heard. This hearing will be held virtually over Zoom. We strongly encourage attendees to RSVP and let us know if they plan to testify. Attendees can join the meeting at any time after 10:15 a.m.
The public comment period for these rules will close on Wednesday, Aug. 2, 2023, at 9:00 a.m.
Join us at an Upcoming Regional Town Hall!
Something exciting is starting in August. That’s when the FAMLI team will start hitting the road and putting on in-person town halls to give employers and employees alike the chance to get any questions answered during a convenient, close-to-home live event. We’re gearing up to open FAMLI benefits at the beginning of 2024, so these events are a great opportunity to find out what’s coming and how your business or your family can take advantage.

We’d love to see you in person, but each stop will also have a virtual option to attend giving you several opportunities to join us. In 2019, I was in a severe car accident that put me out of work for over 6 months. My parents had to take some time off to care for me, so nobody was making any money for a while. A paid family leave program would’ve reduced the burden off of my whole family. We would’ve been able to pay rent on time, I could’ve paid some of my medical bills, I wouldn’t have had to worry about being homeless while I was recovering from life-threatening injuries. I know this will help so many families in the future!

People Are Asking
Q: What will my FAMLI benefits be if I work inconsistent hours, 40 hours one week but 20 hours the next?
A: When someone files a FAMLI leave claim, they’ll also enter the typical number of hours expected to work while absent AND the hours they’ll be absent. For people with multiple employers, they’ll enter the typical hours expected to work for each employer.
The My FAMLI+ system will use this information to calculate the typical working hours per week.
Q: I need to change a wage report or premium payment from a previous quarter. What’s the process for getting an amendment?
A: Amendments can be made at any time. The My FAMLI+ Employer portal will allow amendments up to six quarters back from the present. This can all be done in My FAMLI+ Employer. For changes further back, call contact center at 1-866-CO-FAMLI (1-866-263-2654).
There is no penalty for small adjustments. There will be a $5 penalty per wage that is amended by 25% or more.
Q: I’m an employer who has paid into the system and now have a private plan. Am I entitled to a refund?
A: Yes! Employers who apply to FAMLI for approval to substitute a private plan (carrier or self-insured) by Oct. 31, 2023, and whose effective date is on or before Jan. 1, 2024, are eligible for a refund for any premiums paid to the FAMLI in 2023.
If their private plan expressly allows, the employer may apply those funds to premiums required by the insurance carrier or may deposit the funds in a separate account (self-insured) as required by the regulations.
