 Welcome to the Colorado Department of Labor and Employment's newsletter for Colorado’s new paid Family and Medical Leave Insurance (FAMLI) program. We hope this newsletter provides you with valuable information and resources as we begin implementing the FAMLI program. Premium deductions begin on January 1, 2023 and benefits will be available to workers starting on January 1, 2024. We value your feedback and input! FAMLI Division Regulatory Update
Our proposed rules regarding Private Plans were filed earlier this month and are now published on our rules page. A virtual rulemaking public hearing will be held on Monday, October 17, 2022 beginning at 5 p.m., ending once the last person who wishes to speak has been heard. Anyone may submit comments to the FAMLI Division regarding any proposed or adopted rules at any time. The public comment period for proposed rules on Private Plans (7 CCR 1107-5), will close on Tuesday, October 18, 2022 at 8 a.m.
Proposed rules for Coordination of Benefits and Employer Reimbursement of Advance Payment will be filed in the coming days. Notices of all public hearings are posted on our rules page where you can also read adopted rules, proposed rules, listen to past public hearings and submit public comments.

Resources for Third Party Administrators (TPA’s)
Third party administrators (TPA's) will play a critical role in ensuring many employers are set up for success and remain in compliance with the requirements of the FAMLI program. We’ve created a dedicated page for TPA's with several new resources, including file format specifications for wage reporting and bulk registration, sample files, and payment schedules. If you are a TPA, or work with a TPA, we encourage you to share this page with your administrator to ensure your systems are prepared to begin payroll deductions in January 2023. We’ll be sharing more guidance and how-to guides once My FAMLI+ Employer is live later this year.

 Download the Local Government Guide!
Our Local Government Guide for public employers is now available to download from the Local Governments page on our website. The 20-page guide covers the basics of the program, the unique options for local government participation as outlined by the FAMLI statute, how each option will impact local government employees and valuable research to consider when making an informed decision on whether to conduct a vote to opt out. A break room poster and an employee written notification template are also available for local governments to use to inform their staff about their program participation options.

Statewide Regional Town Halls
We will be wrapping up our Town Hall series by mid-October. The FAMLI team has three stops left! Come chat with the FAMLI team and have your questions answered in-person or virtually. The FAMLI Division is committed to supporting employers across the state as they prepare for premium deductions to begin in January. Every town hall has an option to attend virtually regardless of which region you’re located in. If we didn’t get to your question during our last live webinar, attending a virtual town hall is a great opportunity to get your questions answered on the spot.

Get Ready to Register with My FAMLI+ Employer
The FAMLI team is hard at work building a user-friendly online employer services portal that serves Colorado employers, third party administrators and local government entities. My FAMLI+ Employer will operate similarly to My UI Employer, allowing employers to report wage data, remit premium payments, apply for exemption with a private plan and upload letters of declination votes. We’ll be deploying My FAMLI+ Employer in a phased approach, so we can provide an elevated level of customer service and real time support throughout the registration process. Employers will be invited to register in small groups very soon before the system is live to all employers.
If you are interested in being invited to register early with My FAMLI+ Employer, please fill out this form and tell us if you are a local government employer, third party administrator, business owner or company administrator. All employers will be required to register regardless of participation in the program before the first premium payments and wage reports are due at the end of Q1 2023.
