We are sharing an update regarding today’s court hearing on the Preliminary Injunction (PI) and recent legal developments.
On January 9, 2026, the United States District Court for the Southern District of New York granted a Temporary Restraining Order (TRO) that paused the implementation of a January 6, 2026 letter from the Administration for Children and Families (ACF). That restraining order remained in effect through January 23, 2026.
At the Preliminary Injunction hearing on January 23, 2026, the Court extended the TRO by fourteen (14) days, through February 6, 2026, and stated that the Court will issue a written ruling on the PI.
Additionally, on January 21, 2026, the Department submitted another Child Care and Development Fund (CCDF) drawdown that included the Colorado Child Care Assistance Program (CCCAP) December expenditures through our normal course of business. Those funds were deposited on January 23, 2026, which extends the ability to provide CCCAP reimbursements for services provided through February 28, 2026, and the ability to support non-CCCAP CCDF expenses through March 15, 2026.
The Department is awaiting the written ruling on the PI. Once received, CDEC will work closely with our legal team to understand implications, timelines, and any operational considerations.
