Dear Family Child Care Home Providers,
Effective December 15, 2021, The Division of Early Learning Licensing and Administration (DELLA) allowed all family child care home providers to operate with two children under the age of 18 months where the rules previously required them to be under two years of age. The newest promulgated Rules Regulating Family Child Care Homes have been adopted and went into effect on March 16, 2024. The care for two children under 18 months is reflected in the revised rules, as is the rule that the provider's birth, adopted, step, or foster children 10 years of age and older no longer count in the provider's licensed capacity. These changes allow family child care home providers additional flexibility.
At this time DELLA will not be sending out new licenses to providers. Instead, DELLA asks all licensed home providers to post the New Age Requirements letter next to the license or maintain it on file for review.
