Board of County Commissioners public hearing for receiving public comment on the temporary six-month moratorium

Boulder County, Colo. - The Board of County Commissioners will hold a public hearing on Tues., Oct. 30 regarding the temporary six-month moratorium on proposed development in the Niwot Rural Community District (NRCD).

The staff report to the Board of County Commissioners is posted on the on the DC-18-0004 webpage (the report was updated on October 26, 2018 to correct minor typographical errors.) 

The public hearing is for receiving public comment on whether to terminate or otherwise amend the six-month moratorium on processing applications for development in the NRCD, pending consideration of Land Use Code amendments approved by the Board of County Commissioners’ in Resolution 2018-112.

In-person sign-ups to speak will begin at 3 p.m. on Oct. 30. Individual speakers will have up to 3 minutes to address the Board, or individual speakers may pool/contribute their time to one speaker for a total of up to 10 minutes if everyone who is pooling time is present. The Board will hear from speakers on the sign-up sheet first (in order of sign-up) and then ask others in the audience if they wish to speak.

Background

On September 20, 2018, the Board of County Commissioners (BOCC) authorized staff to review and update the Niwot Rural Community District Regulations (Article 4-116) of the Boulder County Land Use Code. The Commissioners enacted a temporary, six-month moratorium on processing applications for proposed development in the NRCD pending consideration of Land Use Code amendments. Read more on the moratorium, or view the FAQ document.

A public meeting with county staff was held at the Left Hand Grange No. 9 in Niwot on Oct. 17, to gather community feedback on the temporary moratorium. Staff provided an overview and answered questions about the moratorium while gathering community feedback and comments to inform the revisions to the land use regulations for the NRCD. Boulder County Land Use staff is analyzing whether the existing NRCD regulations are sufficient to protect and promote the public health, safety, and welfare, by appropriately balancing changes in development and growth with the present and future needs of the Niwot community.
