This notice provides information about The California Department of Food and Agriculture’s (CDFA) Division of Measurement Standards (DMS) California Type Evaluation Program (CTEP) and requirements for electric vehicle charging stations when being installed for commercial purposes. CDFA-DMS oversees and implements CTEP to evaluate devices intended to be used for commercial purposes to ensure they are accurate, reliable, and do not facilitate fraud; that their design and performance complies with applicable Weights and Measures requirements established in California laws and regulations. CDFA-DMS is also an authorized laboratory for the National Type Evaluation Program (NTEP). NTEP certification may be accepted in California in lieu of CTEP certification provided that the device type also meets all applicable California laws and regulations. To apply for NTEP certification, a manufacturer must submit an NTEP application to the National Council on Weights and Measures.
Electric vehicle chargers, known as electric vehicle supply equipment (EVSE), are formally identified as electric vehicle fueling systems (EVFS). The terms EVFS and EVSE are used synonymously for device enforcement. EVSE is subject to type approval and periodic inspection, testing, and sealing by Weights and Measures officials. EVSE must comply with local, state, and federal laws and regulations, which include type certification, before being placed in service for commercial use. When selecting and installing EVSE, please ensure that:
- The EVSE is type approved if being installed for commercial purpose, such that the fee for any transaction is based upon the quantity of energy delivered as motor vehicle fuel. You can verify CTEP certification for a particular manufacturer’s make and model of EVSE using the CTEP Certificates of Approval Database Search or NTEP Certificates of Conformance Database Search.
2. EVSE operating commercially must be placed in service by a Registered Service Agency (RSA). CDFA-DMS maintains several lists of RSAs on the RSA website. The “Agency List with Device Type” link will allow you to search for RSAs who can install and service EVSE. A word search in the Excel spreadsheet for “electric vehicle charging station” should help locate RSAs that install and service EVSE as indicated in the Device Type column. As of October 1, 2024, there are approximately 23 entries in Column D (Device Type) which indicate RSA licensed in EV charging stations in California.
Manufacturers and installers should direct questions about type evaluation and the applicability of DMS laws and regulations for EVSE to CDFA-DMS.
