Western Joshua Tree Conservation Act Delegation Agreements for Incidental Take Permits
The Western Joshua Tree Conservation Act (WJTCA) allows CDFW to enter into agreements with cities and counties to delegate to those local jurisdictions the ability to authorize the take of western Joshua trees that is incidental to the development of a single-family residence, multifamily residence, or an accessory structure where no more than ten individual western Joshua trees will be taken (by way of an Incidental Take Permit). Incidental Take Permits may also be issued for public works projects that will result in the incidental take of no more than forty individual western Joshua trees.
Permittees applying for an Incidental Take Permit from a city or county must avoid and minimize impacts to and take of western Joshua trees to the maximum extent practicable and must mitigate all impacts to western Joshua trees by paying the applicable fees.
The delegation agreements for Incidental Take Permits are now available. Cities and counties wishing to enter into WJTCA delegation agreements with CDFW should contact WJT@wildlife.ca.gov.
