Diverters in Priority Groups 1-8 must comply with all of the terms in this addendum for their priority group. Please read carefully and contact us if you have questions.
This addendum pertains to all surface water rights and conditionally suspends curtailments when both the priority group’s conditions are met and flows exceed the minimum flow requirements. This provision remains in effect unless modified or replaced by subsequent addenda. Attachment A lists the water rights covered by this addendum and the affected water rights priority groups.
The State Water Resources Control Board (State Water Board or Board) is conditionally suspending curtailments for all surface water diversions, as listed in Attachment A of Order WR 2024-0024-DWR (Order), and as authorized under the Scott River and Shasta River Watersheds Drought Emergency Regulation (Regulation). This Addendum to the Order allows surface water diverters to divert water consistent with their water right if and only if the applicable conditions are met for their water right priority group as outlined below.
-
Cease diversions immediately if directed by the State Water Board.
Note: Priority Group 8 conditions are the same as included in Addendum 10.
-
Cease diversions when the instantaneous flow at the Fort Jones USGS gage approaches the minimum flow requirement (e.g.,150 cfs during May or 125 cfs during June).
-
Cease diversions immediately if directed by the State Water Board.
-
Shall check the flow at the Fort Jones USGS gage prior to and at least every 12 hours during diversion.
-
May commence diversion consistent with their water right(s) when all of the following conditions are met:
-
Flows are increasing and greater than 200 cfs during May (or 175 cfs during June) at the Fort Jones USGS gage; AND
-
May commence diversion consistent with their water right(s) when all of the following conditions are met:
-
Flows are between 150 and 200 cfs during in May (or between 125 and 175 cfs in June); AND
-
The diverter requests and receives approval from the State Water Board to divert a specific amount of water t.
-
Shall cease diversions immediately when any of the following occur:
-
Directed by State Water Board; or
-
The instantaneous flow at the Fort Jones USGS gage approaches 200 cfs during May or 175 cfs during June, unless the diverter requests and receives approval from the State Water Board; or
-
The instantaneous flow at the Fort Jones USGS gage approaches 150 cfs during May or 125 cfs during June.
Following the reinstatement of curtailments for all surface water rights in the Scott River watershed on May 21, 2026, flows continued to decline to low flow of 137 cfs (as measured at the Fort Jones USGS gage around 8:45 pm on May 22, 2026). Thereafter, flows began increasing. On May 25, 2026, the State Water Board issued Addendum 10, conditionally suspending curtailments for Priority Group 8 in the Scott River watershed. As of about 8:30 am on May 27, 2026, the flow at the Fort Jones USGS gage was 167 cfs, it was raining, and there was additional precipitation forecasted in the coming days. Based on flows in excess of the minimum flow requirement and favorable temperature and precipitation forecasts, it is appropriate to conditionally suspend surface water right curtailments.
All conditional suspensions require that diversions cease when the instantaneous flow at the Fort Jones USGS gage is approaching the minimum flow requirement or upon notification by the State Water Board. For reference, the required minimum flows for the Scott River watershed in the coming months are the natural flow of the system up to the amounts listed in the table below, as measured in cubic feet per second (cfs), at the Fort Jones USGS gage.
The Regulation allows for limited diversions under curtailed water rights for specific purposes. More information on these exceptions can be found below.
Pursuant to flow regulations that establish minimum instream flows for fishery protection, which with minor exceptions and changes have been in effect since August 30, 2021, the State Water Board issued a curtailment order (Order WR 2024-0024-DWR) on July 23, 2024. It curtailed all surface water rights in the Scott River watershed, as specified in Attachment A of the Order. Subsequent addendums have been issued to suspend or reinstate curtailments as required to maintain minimum flow requirements established in the Regulation. Flow measurements were taken in the field on May 14, 2026, and resulted in an upward adjustment to the flow readings at the Fort Jones USGS gage. An additional flow measurement was conducted on May 20, 2026, that resulted in a downward adjustment to the flows at the Fort Jones USGS gage. Flows dropped below the May minimum flow requirement on May 20, 2026. Addendum 9 was issued on May 21, 2026, curtailing all surface water diversions in the Scott River watershed. On May 23, 2026, rebounding flows met the minimum flow requirement for May and continued to rise. On May 25, 2026, Addendum 10 was issued suspending curtailments for Group 8, the highest priority surface water rights. As of May 27, 2026, flows have been steady around 167 cfs at the Fort Jones USGS gage. Precipitation forecasts show significant rainfall and that flows are expected to increase. Due to flows substantially increasing and remaining above the minimum requirement of natural flows up to 150 cfs for May and up to 125 cfs for June, and the forecasted precipitation, the State Water Board is conditionally suspending curtailments for all surface water rights as noted above.
Based on the current flow and the increasing trend and sustained flows above the minimum flow requirement in response to recent curtailments and precipitation, the suspension of curtailment for surface water rights is appropriate. While flows have increased with the implementation of curtailments and current precipitation, overall flows are anticipated to follow a broad downward trend at the Fort Jones USGS gage due to insignificant snowpack, water demand, seasonal drought, long-term temperature forecasts, and a comparison to flows in recent years with similar snowpack measurements. While the lack of snowpack, seasonal forecasts, and historic flows indicate curtailment will be necessary for much of the irrigation season, the State Water Board will continue to monitor flows, flow forecasts, precipitation and temperature forecasts, and watershed conditions regularly to determine if adjustments to the curtailments are appropriate.
Allowances for Continued Limited Diversions
The Regulation has exceptions for certain types of diversions that may continue even after you receive a curtailment order, if the appropriate form(s) is submitted to the State Water Board (see more on this below). These exceptions are:

Non-consumptive Diversions. This exception applies if your diversion is not consumptive, meaning that it does not use up water or change the time the water is available to others (e.g., run-of-river hydropower with returns entering the same stream, instream use).

Minimum Human Health and Safety Diversions. This exception applies if a curtailed diversion is your only water source for minimum human health and safety purposes, like drinking, cooking, washing, or meeting the state’s critical infrastructure needs. Please note that diversions for firefighting may continue under this exception.
-
Minimum Livestock Watering Diversions. This exception applies if a curtailed diversion is your only source for minimum livestock watering. See section 875.3 in the Regulation for more information on minimum livestock watering.
Reporting, certification, and petition forms previously submitted for the Order are still active and do not need to be resubmitted, unless you are updating your previous submittal. If you want to continue diverting using one of the above exceptions, and you have not submitted information already, you must submit the relevant information to the State Water Board. ORDER IMPOSING WATER RIGHT CURTAILMENT AND REQUIRING REPORTING FOR SURFACE WATER RIGHTS IN THE SCOTT RIVER WATERSHED
The Curtailment Group number is based on the order of priority outlined in Regulation section 875.5(a)(1). Group 1 is curtailed first and suspended last (i.e., most junior water right priority), Group 8 is curtailed last and suspended first. Please note that water rights of Group 2 refer to the Surplus Rights only, not the other water rights of the owner. Please also note that ownership is as listed in the Scott River Decree. This list should be understood to include the successors and assigns of the owners at this time. Group 2 Surplus Rights are generally unavailable in drought years and are only available when all other rights under the Scott River Decree have been fully satisfied.
