2022 Construction Stormwater General Permit Effective Date Announcement
On September 8, 2022, the State Water Resources Control Board adopted Construction Stormwater General Permit Order WQ 2022-0057-DWQ (2022 CGP) with an effective date of September 1, 2023, and a two-year regulatory transition period for dischargers with existing coverage under Order WQ 2009-0009-DWQ (2009 CGP).
As of September 1, 2023, Dischargers with coverage under the 2009 CGP shall continue to comply with the 2009 CGP requirements. Permit Registration Documents submitted on or after September 1, 2023, must comply with the requirements set forth in the 2022 CGP. Once the two-year regulatory transition period ends on September 1, 2025, all dischargers with permit coverage under the 2009 CGP will be administratively terminated and must obtain new permit coverage under the 2022 CGP if construction activity is continuing.
After September 1, 2023, Water Board staff will not approve Changes of Information (COIs) requesting to increase the disturbed acreage of a project or modify a Small Construction Rainfall Erosivity Waiver under the 2009 CGP. Dischargers needing to add disturbed acreage or modify the Erosivity Waiver must seek coverage under the 2022 CGP. Dischargers may continue to submit COIs to reduce acreage for projects covered under the 2009 CGP during the regulatory transition period.
