The California Air Resources Board (CARB) staff invites you to participate remotely in a public workshop to discuss proposed amendments to the Procedures for Exemption of Add-on and Modified Part(s) for On-Road Vehicle(s)/Engine(s). The proposed amendments will clarify, modify, and update the processes and criteria for obtaining an exemption Executive Order (EO) in order to increase the transparency and efficiency of the application review process. Staff will review and present the proposal and seek input from interested stakeholders.

Background
California’s Anti-Tampering Law (Vehicle Code section 27156) prohibits the sale, offer for sale, or installation of aftermarket parts that alter or modify the original design or performance of vehicles or engines. An aftermarket part is any component or device used on a vehicle or engine that was not part of the vehicle or engine when it was originally certified. Aftermarket parts which are not functionally identical to the original equipment part, in all respects that have the potential to affect emissions, are considered add-on and modified parts, and are required to receive a CARB exemption EO prior to sale, offer for sale, or installation.
The aftermarket parts program evaluation procedures, “Procedures for Exemption of Add-on and Modified Part(s) for On-Road Vehicles/Engines” (Procedure), incorporated by reference in the California Code of Regulations (CCR), Title 13, Division 3, Chapter 4, Article 2, Section 2222, Subdivision (e) and Section 2224, Subdivision (b), was designed to clarify, streamline, and update CARB’s processes to obtain exemptions to legally sell add-on and modified parts in California for on-road vehicles and engines. The Procedure was adopted June 29, 2021 and took effect January 1, 2022, for exemption requests submitted on or after January 1, 2022. The Procedure was amended on March 23, 2023, to address the special considerations associated with electric vehicle conversions. The amendments to the Procedure took effect on October 26, 2023.
Staff have identified areas of the Procedure which can be further modified to improve clarity, as well as streamline and update CARB’s processes associated with application submission and EO issuance. The proposed amendments include modification of the application submission requirements, provision of alternative test vehicle or engine selection criteria, and modification of the labeling requirements. The workshop will discuss the proposed changes to the Procedure and solicit feedback from interested stakeholders.
