The Regulation for In-Use Off-Road Diesel-Fueled Fleets (Off-Road Regulation) mandates that fleets that are required to report their off-road diesel equipment to the California Air Resources Board (CARB) pursuant to Cal. Code Regs., tit. 13, § 2449, submit an annual report and Responsible Official Affirmation of Reporting (ROAR) by March 1st of each reporting year. Annual reporting began January 1st.
For the annual report, fleets must report all changes made to the fleet including any updated contact information. Fleets must also submit engine hour meter readings for vehicles reported as “Low-Use” (if applicable) or vehicles used for agricultural operations 51-99% of the time (if applicable) and submit the Responsible Official Affirmation of Reporting (ROAR) form. CARB provides the electronic ROAR (e-ROAR) as a convenience for fleets. Approved Amendments to Off-Road Regulation
CARB approved amendments to the Off-Road Regulation on November 17, 2022, aimed at further reducing emissions from the off-road sector. The following are key elements:
- Engine tier and model year phase‑out requirement. Dates vary by fleet size.
- Ban on the addition of vehicles with Tier 3 and 4i engines.
- Requirement starting January 1, 2024, to use R99 or R100 renewable diesel in off-road diesel vehicles.
- Requirement for prime contractors and public works awarding bodies to obtain and retain a fleet’s valid Certificate of Reported Compliance prior to awarding a contract or hiring a fleet.
- Voluntary compliance flexibility options for fleets that adopt zero-emission technology.

Background
On July 26, 2007, CARB adopted the Off-Road Regulation to reduce diesel particulate matter and oxides of nitrogen emissions from in-use (existing) off-road heavy-duty diesel vehicles in California. These vehicles are used in construction, mining, industrial operations, and other industries. CARB approved amendments strengthening the Off-Road Regulation on November 17, 2022.
