Phase Out Date and Modification Deadline for Tier 3 Engines Owned by Large Fleets


Upcoming Phase Out Deadline Reminder:

December 31, 2024 Phase Out Date

This is the phase out date for Tier 3 portable diesel engines owned by large fleets and built prior to 2009 rated 50 brake horsepower (bhp) to 750 bhp. Large fleets were established on June 30, 2019, and have a total cumulative horsepower over 750 bhp for all portable engines under common ownership and control of the fleet.  

These engines, whether registered in PERP, locally permitted, or otherwise subject to the Portable Diesel Engine Airborne Toxic Control Measure, will no longer be able to operate in California after December 31, 2024. 

The engine tier and phase out date are listed on each applicable PERP registration certificate. To continue operation past the phase-out date, you must submit a modification request using PERP Form 20 and elect one of the following options.

Option 1 - Must be postmarked between January 1 and January 31, 2024

Modify to either:

  • Low use (limited to 200 hours per calendar year); or
  • Emergency use (limited to emergency operation only).

Option 2 - Must be postmarked on or before December 31, 2024

Add a properly functioning level-3 verified emission control technology that will enable full use of the engine after December 31, 2024.
