The California Air Resources Board (CARB) staff invites you to participate remotely in a public workshop to discuss the recently released U.S. Environmental Protection Agency (U.S. EPA) Clean Trucks Plan nitrogen oxides (CTP-NOx) rule. The rule is part of a larger strategy that proposes a series of clean air regulations to reduce emissions from the heavy-duty (HD) sector as part of the transition to electrification and decarbonization of this sector.

Since the release of the CTP-NOx final rule on December 20, 2022, CARB staff has reviewed the regulatory language to understand the differences between the federal program and California’s HD Omnibus regulation. CARB staff has identified two elements of the CTP-NOx program, which are different from the Omnibus requirements, that introduce emissions differences between the two regulations. At the workshop, CARB staff will share technical evaluations of those elements as well as implications for emissions losses should CARB align with the federal regulation.

The first element is the temperature adjustment to the off-cycle NOx standards (temperature adjustment) as described in Title 40, Code of Federal Regulation, §1036.104 (a)(3), i.e., 40 CFR §1036.104 (a)(3). This element, which applies at temperatures between 5 and 25 degrees Celsius, conditions commonly encountered by trucks in California and the nation, was not included in the CTP-NOx notice of proposed rulemaking (NPRM). CARB staff will present tailpipe emissions data from current model trucks on-the-road along with ambient and exhaust temperature data.

The second element of the CTP-NOx rule is the interim NOx compliance allowance for in-use testing as described in 40 CFR §1036.150 (y). Although this was introduced as an interim measure in the proposed rule, the sunset date for this provision has been removed in the final rule.

Staff will also discuss a potential way to make up for the benefit loss due to these two elements by encouraging additional HD zero-emission vehicle (ZEV) production within the upcoming federal Phase 3 greenhouse gas (GHG) rulemaking. U.S. EPA is expected to propose Phase 3 GHG standards in March 2023.

Background

On August 27, 2020, CARB approved the Omnibus regulation which became effective on December 22, 2021, when the Office of Administrative Law approved the regulation. The objective of the Omnibus regulation was to reduce the NOx emissions standards, increase the useful life and warranty periods, enhance the durability demonstration requirements, and introduce new in-use testing protocols for HD trucks.

U.S. EPA released its NPRM for the CTP-NOx rule on March 7, 2022. The final version of the CTP-NOx rule was released on December 20, 2022 and published in the January 24, 2023, edition of the Federal Register. The CTP-NOx rule includes elements that are similar to the Omnibus regulation, but the levels of stringency between many elements of the two regulations are different.
