Invitation to Participate


The California Air Resources Board (CARB) invites you to participate in a public discussion to review the newly adopted “Procedures for Exemption of Add-On and Modified Part(s) for On-Road Vehicles/Engines”, which will become effective January 1, 2022. The discussion will begin with a brief overview of the new procedures followed by a staff presentation and open discussion regarding the forms to be used for category specific applications. CARB staff is soliciting constructive feedback on the implementation of the new procedures and the proposed application forms.

Background

California Anti Tampering Laws (Vehicle Code (VC) 27156 and VC 38391) prohibit the sale, operation, and modification of engines or vehicles from their originally certified configuration.  Add-on and modified parts are defined in California Code of Regulations, title13, section 1900 (b) (1 and 10) and section 2222.

The aftermarket parts program current evaluation procedures, “Procedures for Exemption of Add-on and Modified Parts” will be replaced on January 1, 2022 with the new “Procedures for Exemption of Add-On and Modified Part(s) for On-Road Vehicles/Engines”.  The new procedures provide updated process and criteria for manufacturers of add-on and modified parts that will apply to applications received by CARB on or after January 1, 2022.  Applications received by CARB before January 1, 2022 will be evaluated under the current evaluation procedures.

The new “Procedures for the Exemption of Add-On and Modified Part(s) for On‑Road Vehicles/Engines” will be more relevant to today’s vehicles or engines by providing CARB the needed information to process applications in a more organized and streamlined way.  Manufacturers will have more clarity on information needed in application submissions, and the procedures will provide a clearer description of the CARB evaluation process and testing requirements to promote robust documentation for quicker CARB review.
