Workshop Notice: California Consumer Price Index-Increased Maximum Penalties


California State law requires that maximum penalties for violations of vehicular (AB 1685, Gomez, 2016) and non-vehicular (AB 617, Garcia, 2017) air pollution control laws and regulations be increased annually to reflect inflation, based on the California Consumer Price Index (CCPI) published by the California Department of Industrial Relations. CARB staff invite you to participate in a public workshop and webinar to discuss updates to CARB’s Enforcement Policy related to maximum penalty increases based on the CCPI, implementing AB 617 and 1685.

This workshop will include a presentation covering the above topic. At the conclusion of the presentation, there will be an opportunity for an open discussion on the topic. CARB staff will be available after the presentation to respond to additional questions and to solicit stakeholder feedback.


Proposed Enforcement Policy Amendment

CARB staff proposes to revise CARB’s Enforcement Policy to implement these requirements and make the regulated community and the public aware of these requirements. CARB staff plans to annually publish a table of CCPI-increased maximum penalties in CARB’s Enforcement Report and on its website. CARB staff would use the CCPI-increased penalties when assessing penalties pursuant to the Enforcement Policy.
