Public Hearing to Consider Proposed Amendments to the Regulation tor Limiting Ozone Emissions from Indoor Air Cleaning Devices


The California Air Resources Board (CARB or Board) will conduct a public hearing at the time and place noted below to consider approving for adoption the proposed amendments to the regulation for limiting ozone emissions from indoor air cleaning devices.

9:00 a.m., December 12, 2019, and may continue at 8:30 a.m., on December 13, 2019. Please consult the agenda for the hearing, which will be available at least ten days before December 12, 2019, to determine the day on which this item will be considered.


Background

CARB adopted the indoor air cleaner regulation in 2007, setting a 0.05 parts per million (ppm) ozone emission concentration limit on indoor air cleaning devices that are manufactured, sold, or offered for sale for use in California. This includes air cleaners sold through online sales. Devices must be tested by a CARB-approved laboratory in accordance with the type of device. The regulation also includes device labeling and notification requirements, as well as specific industrial exemptions. To date, CARB has certified nearly 2,500 air cleaning devices manufactured by more than 330 companies.

The regulation has successfully reduced the potential for Californians to be exposed to ozone from portable air cleaning devices. In the decade since the original adoption, the California air cleaner market has diversified and expanded. There have been changes in air cleaner technology and increasing sales driven by California-specific market drivers such as widespread smoke impacts from wildfires and public concern about health effects from air pollution.

CARB recognizes the need for amendments to strengthen the regulation to address market changes, streamline and clarify the certification process, and update areas of the regulations text. The proposed amendments are intended to improve public health by addressing additional air cleaning devices and modifying industrial use exemptions. These amendments will ensure that Californians are not exposed to unhealthy levels of ozone in their homes from air cleaning devices.

Written Comment Period & Comment Submittal

In accordance with the Administrative Procedure Act, interested members of the public may present comments orally or in writing at the hearing and may provide comments by postal mail or by electronic submittal before the hearing. The public comment period for this regulatory action will begin on October 25, 2019. Written comments not physically submitted at the hearing must be submitted on or after October 25, 2019, and received no later than December 9, 2019. Any written comments on the Environmental Analysis must be submitted on or after October 25, 2019, and received no later than December 9, 2019. Comments submitted outside that comment period are considered untimely. CARB may, but is not required to, respond to untimely comments, including those raising significant environmental issues.
