Abortion care is healthcare; and in California, access to abortion care is a constitutionally-protected right. At DOJ, we will always defend our reproductive rights and ensure California remains a beacon of reproductive freedom.
That’s why, when Beverly Hills unlawfully interfered with — and ultimately prevented — a new reproductive health clinic from opening, we stepped in.
The agreement the city and my office announced this week will prevent Beverly Hills from stymying another reproductive clinic from opening and made it clear that DOJ is now on alert. While this agreement is a step in the right direction, our enforcement should never have been necessary. Communities must do their duty to uphold reproductive rights, and should do everything in their power to welcome new providers and protect patients — at DOJ, we will accept nothing less.

Holding Beverly Hills Accountable for Illegally Blocking Reproductive Health Clinic
 In September 2022, DuPont Clinic — an abortion provider in Washington, D.C. — sought to open a clinic in Beverly Hills. Despite the city's public position of support for abortion rights, our DOJ investigation found that Beverly Hills unlawfully interfered with DuPont’s opening by improperly delaying the issuance of approved building permits and actively engaging in a pressure campaign against the property owner and manager Douglas Emmett. For instance, city leadership — including the City Manager, Police Chief, City Attorney and the former Mayor — inaccurately claimed that a new DuPont Clinic would cause security threats against the building’s other tenants, going so far as to say that the building would be subject to violent protests, bomb threats, and “lone-wolf” active shooters. In fact, the city had no evidence or intelligence of any such threats.

Protecting Emergency Abortion Care
 In addition, I secured a stipulation from Providence St. Joseph Hospital in Eureka that will ensure the hospital follows California law while our case proceeds. Filed on September 30, 2024, our lawsuit alleges that the hospital violates multiple state laws by, as a matter of policy, denying pregnant patients the emergency abortion care they need. While Providence St. Joseph should have been complying with state law up to now, thereby avoiding the harm and trauma to Californians they caused, I am pleased that the hospital has agreed to fully comply with the law going forward, ensuring access to life-saving health services including emergency abortion care.

Securing Appellate Victory Against Huntington Beach
 This week, the U.S. Court of Appeals for the Ninth Circuit emphatically rejected Huntington Beach’s attempt to exempt itself from state housing laws. While the city has been wasting the public’s time and money pursuing this meritless federal lawsuit, its neighboring communities — along with every Californian struggling to keep a roof over their heads or wondering where they’re going to sleep tonight — need Huntington Beach to step up and adopt a housing plan without further delay. My office will continue pursuing all remedies in the state case against the city, where the court has already determined the city violated the state’s Housing Element Law.

Ensuring Compliance with California's Housing Laws
 In partnership with California Governor Gavin Newsom and California Department of Housing and Community Development (HCD) Director Gustavo Velasquez, I announced a settlement this week with the City of La Habra Heights. Instead of continuing to skirt California’s housing laws, the city will finally be complying with its legal obligation to plan for 244 housing units. My office will not let up: no matter the size of the city or county, we will not rest until every local government in California plans for the future and does its part to tackle our housing crisis.

Supporting Federal Prohibition on Price Gouging
 During and after a crisis, it is unfair — and harmful to our economy — for companies to reap higher profits for selling goods and services that families need to survive. That is why California’s price gouging law protects Californians during and after wildfires, severe weather storms, and other emergencies. This week, I joined 16 attorneys general in supporting a federal price gouging prohibition, which would provide critical partnership to state enforcement, protect both consumers and small businesses, and strengthen existing state laws.

 Here in California, all active registered voters are mailed vote-by-mail ballots because we want to make it as easy as possible for your voice to be heard. California law also permits voters to entrust their completed mail ballots to someone else for delivery to election officials, which is another way our state makes it easier for people to vote.
But, to ensure the integrity of our elections, those who accept another person’s ballot for delivery have serious responsibilities and, with the bulletin we issued this week, we want to raise awareness of those responsibilities.
Active registered voters can track their ballots by signing up at wheresmyballot.sos.ca.gov and voters unsure of their registration status can check online at voterstatus.sos.ca.gov.
