 SB 54 Notification Regarding Demonstration of Expanded Polystyrene Recycling Rate in California

As part of CalRecycle’s continued commitment to providing compliance assistance, CalRecycle has provided notification letters to entities that may be affected by restrictions on expanded polystyrene (EPS) food service ware, per Public Resources Code (PRC) section 42057(i) of the Plastic Pollution Prevention and Packaging Producer Responsibility Act, Senate Bill No. 54 (Allen, Chapter 75, Statutes of 2022) (SB 54). These letters inform the entities that the recycling rate demonstration required in order to continue selling EPS food-service ware in California has not been met. As a result, EPS producers are prohibited from selling, offering for sale, distributing, or importing EPS food service ware in or into California. The letter provides links to resources and guidance to help businesses understand their obligations under the law.
