The Department of Resources Recycling and Recovery (CalRecycle) has previously held three informal rulemaking workshops on draft regulatory concepts and draft regulatory language for the SB 156 Handling Fee Rate Determination Emergency Regulations.  

Following these workshops, CalRecycle revised the draft regulatory language that was shared with the public. The proposed regulation text now includes language describing the process for the cost-of-living adjustment (COLA) applied to handling fees to better meet the clarity standard for regulations in Government Code section 11349.1(a)(3). As a result, CalRecycle is sharing the revised draft regulatory language for feedback by close of business on Friday, April 25, 2025. 

CalRecycle anticipates beginning the emergency rulemaking process in May.
