Hyperion Updates
August 7, 2023
Below are the most recent updates on the situation with the Hyperion Water Reclamation Plant.
- Bill AB-1216 Wastewater Treatment Plants: Monitoring of Air Pollutants:
- City staff and councilmembers continue to work with Assemblymember Al Muratsuchi's office and various stakeholders on bill AB 1216.
- Bill AB 1216 is tentatively scheduled to be heard at the Senate Appropriations Committee Hearing on a date TBD in August, 2023.

- Hyperion Activity
- Tank Cover Measurement Activity - Starting August 7 until August 18, 2023, on weekdays between 7:00 a.m. - 5:00 p.m. there will be tank measurement activities of Primary Battery D, which may release odor. After the City held several conversations with Hyperion and AQMD staff, it was determined that delaying the measurement of the tank covers is not practical. The City will continue to work with Hyperion to minimize the odor impact of this project.
- July Hyperion Citizens Forum Meeting
- On July 20, 2023, Hyperion held its quarterly Hyperion Citizens Forum meeting, which was attended by Councilmember Carol Pirsztuk and Director of Public Works Elias Sassoon. The City has requested that Hyperion announce these meetings at least one week in advance and to include the zoom link with the announcement.
- AQMD
- On July 25, 2023, South Coast Air Quality Management District (SCAQMD) issued a Notice of Violation (NOV) to the Hyperion Water Reclamation, for elevated levels of Hydrogen Sulfide (H2S) on June 19, 2023 during scheduled scrubber maintenance and for violating requirements to reduce odors impacting the community. - Dr. Michael K. Stenstrom, Wastewater Treatment Plant Expert, continues to track Hyperion's progress implementing the 33 recommendations from the Hyperion Ad Hoc Committee formed after the July 2021 spill and is scheduling a tour of Hyperion for himself and the Environmental Committee.
- The Hyperion Ad Hoc Committee comprised of Councilmember Carol Pirsztuk, Councilmember Ryan Baldino, and Environmental Committee Chair Tracey Miller-Zarneke continue to meet with the City Manager weekly.
Tank Cover Measurement Activity August 7 - August 18, 2023
The tank cover measurements will take place August 7th through August 18th between 7:00 a.m. and 5:00 p.m. during weekdays.
The measurements are needed for the fabrication of new tank covers. The existing tank covers must be temporarily removed to complete this task.
This task will generate odors which could be exacerbated due to hot weather.
City staff requested that this activity be deferred to the Fall when the weather will be cooler. After several conversations with Hyperion and AQMD staff, it was determined that delaying the measurement of the tank covers is not practical.
The City will continue to work with Hyperion to minimize the odor impact of this project.
